January 9, 2001 (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Joyous Sound Education and Enrichment Center is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a child care facility on property located at 205 Gust Lane, and being more particularly described as: UP-O0-19 Beginning at the northwest corner of Gust Lane and Avondale Road; thence, in a westerly direction 275 '+ to a point; thence, in a southwesterly direction 30'+ to a point; thence, in a northwesterly direction 250'+ to a point; thence, in a northeasterly direction 245'+ to a point; thence, in a southeasterly direction 420'+ to a point of the beginning. 3. That the use permit is approved subject to the following conditions: (a) The occupancy of the childcare center may not exceed 201children at any one time. (b) The age range of the children shall be from 2 ½ to twelve years of age. (c) Hours of operation shall be limited to between 6:00 a.m. and 6:00 p.m., Monday through Friday. (d) The outdoor play area shall be enclosed with fencing at least four feet in height. (¢) No more than thirty-one children shall occupy the outdoor play area at any one time. (t') Outdoor play hours shall be limited to the hours between 8:00 a.m. and 6:00 p.m. (g) The applicant shall maintain a minimum of forty-four on-site parking spaces for the childcare center. (h) The center shall comply with the floor plan and site plan as submitted with the application. (i) The center shall submit to all required inspections by the City's Fire Prevention Bureau, Public Health Department and Building Official and shall correct any code deficiencies noted during the inspections. (j) The applicant shall comply with all applicable codes, ordinances, and regulations of federal, state and local governments and shall obtain and maintain all necessary licenses and permits. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council."
