January 9, 2001 <br /> <br /> (d) A Group 1 landscape buffer with fencing shall be installed and maintained <br />along the property boundary of the adjacent apartment complex. A portion of the <br />required buffer may be constructed and maintained on a permanent easement provided <br />by the adjacent property owner. <br /> <br /> (e) Customer access to and from the new mini-storage area shall be through <br />the existing storage area access gate. Use of the emergency driveway access gate <br />shall be on an exception basis and conducted only during posted office hours. <br /> <br /> (f) The architecture, exterior materials, colors and lighting shall match the <br />details of the present storage units. <br /> <br /> (g) Customer access to the storage units shall be limited to between the hours <br />of 7 A.M. and 9 P.M., seven days a week. <br /> <br /> (h) The applicant shall comply with all applicable codes, ordinances, and <br />regulations of federal, state and local governments and shall obtain and maintain in <br />effect all necessary licenses and permits. <br /> <br /> (i) All taxes and fees in connection with the subject property and operation <br />shall be paid when due. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Whitehurst, Holley <br />Nays: None <br />Abstained: Robinett (Abstained because of a family member who has financial benefit <br />in the item.) <br /> <br /> Motion by Mr. Benn, and seconded <br />resolution, approved at the December 12, <br />following vote: <br /> <br />by Mr. Robinett, to adopt the following <br />2000 meeting, and was adopted by the <br /> <br />00-233(b): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO JOYOUS SOUND EDUCATION <br />AND ENRICHMENT CENTER FOR THE OPERATION OF A CHILD CARE CENTER <br />AT 205 GUST LANE. <br /> <br /> WHEREAS, Joyous Sound Education and Enrichment Center has made <br />application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia <br />(1988) for the granting of a use permit to operate a child care center at 205 Gust Lane, <br />Portsmouth, Virginia; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting the <br />application for a use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br /> <br />
