January 9, 2001 (d) A Group 1 landscape buffer with fencing shall be installed and maintained along the property boundary of the adjacent apartment complex. A portion of the required buffer may be constructed and maintained on a permanent easement provided by the adjacent property owner. (e) Customer access to and from the new mini-storage area shall be through the existing storage area access gate. Use of the emergency driveway access gate shall be on an exception basis and conducted only during posted office hours. (f) The architecture, exterior materials, colors and lighting shall match the details of the present storage units. (g) Customer access to the storage units shall be limited to between the hours of 7 A.M. and 9 P.M., seven days a week. (h) The applicant shall comply with all applicable codes, ordinances, and regulations of federal, state and local governments and shall obtain and maintain in effect all necessary licenses and permits. (i) All taxes and fees in connection with the subject property and operation shall be paid when due. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." Motion by Mr. Benn, and seconded resolution, approved at the December 12, following vote: by Mr. Robinett, to adopt the following 2000 meeting, and was adopted by the 00-233(b): "A RESOLUTION GRANTING A USE PERMIT TO JOYOUS SOUND EDUCATION AND ENRICHMENT CENTER FOR THE OPERATION OF A CHILD CARE CENTER AT 205 GUST LANE. WHEREAS, Joyous Sound Education and Enrichment Center has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate a child care center at 205 Gust Lane, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses;
