<br />October 24. 2006 <br /> <br />"ORDINANCE ADOPTING A NEW CODE FOR THE CITY OF PORTSMOUTH, <br />VIRGINIA; REPEALING CERTAIN ORDINANCES NOT INCLUDED IN THE NEW <br />CODE; MAINTAINING IN EFFECT CERTAIN OTHER ORDINANCES NOT INCLUDED <br />IN THE NEW CODE; AND ESTABLISHING GENERAL PENALTIES FOR CODE <br />VIOLATIONS. " <br /> <br />Ayes: Moody, Heretick, Psi mas, D. Smith, R. Smith, Randall <br />Nays: None <br /> <br />06 - 491 - Adoption of a resolution consenting to the declaration of a local emergency in <br />the City of Portsmouth, Virginia as a result of the damage and destruction caused by <br />Tropical Storm Ernesto. Vision Principle: A Robust and Prospering Economy. <br /> <br />Background: <br />. On August 31, 2006, Governor Timothy Kaine declared a state of emergency as <br />a result of the anticipated destruction and damage from Tropical Storm Ernesto that <br />later passed through the City of Portsmouth on August 31 and September 1, 2006. <br />. Tropical Storm Ernesto produced larger quantities of rain than anticipated by the <br />National Weather Service and National Hurricane Center and caused major property <br />damage as reported by the Southeastern Public Service Authority (SPSA) and one <br />other property owner in the City of Portsmouth several days after the event. <br />. SPSA reported the largest amount of damages totaling $1.6 million. <br /> <br />Discussion: <br />. All disaster-related expenditures must be documented in order to be eligible for <br />post-disaster reimbursement. This information has been reported to the Virginia <br />Department of Emergency Management as part of the State's declaration. <br /> <br />Financial Impact: <br />. Declaring a local emergency and reporting damages on behalf of SPSA and the <br />other Portsmouth property owner, may facilitate their disaster recovery efforts. <br /> <br />Staff Recommends: <br />Adoption of proposed resolution. Vision Principle: A Robust and Prospering Economy. <br /> <br />Next Steps Following Council Action: <br />. The Office of Emergency Management will assist with eligible state or federal <br />reimbursements, as appropriate. <br /> <br />Motion by Mr. Moody, and seconded by Mr. D. Smith, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"RESOLUTION CONSENTING TO THE DECLARATION OF A LOCAL EMERGENCY <br />IN THE CITY OF PORTSMOUTH, VIRGINIA AS A RESULT OF THE DAMAGE AND <br />DESTRUCTION CAUSED BY TROPICAL STORM ERNESTO. <br /> <br />WHEREAS, on August 31, 2006, Governor Kaine declared a state of emergency <br />as a result of the anticipated destruction and damage from Tropical Storm Ernesto, and <br /> <br />WHEREAS, Tropical Storm Ernesto passed through the City on August 31 and <br />September I, 2006, and produced large quantities of rain that caused major property <br />damage reported by SPSA, located in Portsmouth, and damage reported by one other <br />property owner, and <br /> <br />WHEREAS, these claims were timely reported to the Virginia Department of <br />Emergency Services (VDEM) by the Deputy Coordinator of Emergency Management for <br />the City of Portsmouth, and VDEM requests a declaration of local emergency to assess <br />the reported damage, and <br />
