<br />255 <br /> <br />October 24, 2006 <br /> <br />WHEREAS, Section 44-146.16 of the Code of Virainia, defines "emergency" to <br />include an occurrence that results in substantial injury or harm to the population or <br />substantial damage to or loss of property, and, a declaration of local emergency is <br />needed for the government to deal effectively with this reported damage; <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia, that it hereby declares that a local emergency existed in the City <br />of Portsmouth as a result of Tropical Storm Ernesto beginning August 31,2006. <br /> <br />BE IT FURTHER RESOLVED that, pursuant to the powers granted by Section <br />44-146.21 of the Code of Virginia, Sections 2-656 et seq. of the Code of the City of <br />Portsmouth, Virginia, and Article V of the Portsmouth City Charter, that it hereby <br />consents to the declaration of a local emergency by the City's Director of Emergency <br />Management, who shall have the powers, functions and duties prescribed by the laws of <br />the Commonwealth and the ordinances of the City of Portsmouth with respect to said <br />local emergency. <br /> <br />BE IT FURTHER RESOLVED that, all emergency actions having been taken, it <br />declares that the local emergency is ended." <br /> <br />Ayes: Moody, Heretick, Psimas, D.
