July 27, 1993 UP-93-7 1,4-5 Beginning at the southwest intersection of Ann and Owens Streets; thence south along the west right-of-way of Owens Street to the south right-of-way line of Blair Street; thence west 7' more or less to a point; thence southwest 107.13' to a northern boundary line of Oak Grove Cemetery; thence northwest 50' to a point; thence west 70' more or less to a point; thence north 80.06' to a point; thence northwest 65' more or less to a point; thence west 62' more or less to a point; thence northwest 155' more or lees to a point; thence west 65' more or less to a point; thence northerly 120' to a point; thence eaet a distance of 375' more or less to the southwest intersection of Ann and Owens Streets, the point of origin. 3. That the use permit is approved subject to the following conditions: (1) The applicant shall provide at least thirty-four (34) off-street parking spaces. These spaces may be provided on-site or off-site, on City-owned property, as shown on Exhibit A, attached hereto and made a part hereof. (2) If the required parking includes off-site spaces, the applicant shall enter into a lease or other agreement for the spaces, which instrument shall be in a form approved by the City Attorney. The lease or agreement ehall be recorded in the office of the Clerk of the Circuit Court for the City of Portsmouth prior to issuance of a building permit. (3) If off-site parking is used to meet the parking requirements, the use permit shall become void if the parking agreement is ever terminated. The uee permit shall not terminate, however, if within sixty (60) days of termination of the agreement, a substitute agreement is presented to and approved by the City Attorney or if construction of the requisite number of spaces is commenced on-site. (4) Ail improvements shall be constructed in accordance with Exhibit A. (5) The applicant ehall comply with all applicable codes, ordinancee, and regulations of federal, state and local governments and shall obtain all necessary licenses and permits." A. Sheets Mechanical General Contractor. "The 1992-97 Capital Improvements Program (CIP) identifies the Highland Biltmore area for future infrastructure improvements. As the first phase of these improvements, this CIP includes funds in prior authorizations for relocation of the existing deteriorated sewer system from the backyards to the streets. The homeowners will be responsibls for the costs of shifting their existing sewer service to our new mains.
