That the use permit is approved subject to the following <br />conditions: <br /> <br />(1) The applicant shall provide at least thirty-four (34) <br />off-street parking spaces. These spaces may be provided on-site <br />or off-site, on City-owned property, as shown on Exhibit A, <br />attached hereto and made a part hereof. <br /> <br />(2) If the required parking includes off-site spaces, the <br />applicant shall enter into a lease or other agreement for the <br />spaces, which instrument shall be in a form approved by the City <br />Attorney. The lease or agreement ehall be recorded in the <br />office of the Clerk of the Circuit Court for the City of <br />Portsmouth prior to issuance of a building permit. <br /> <br />(3) If off-site parking is used to meet the parking <br />requirements, the use permit shall become void if the parking <br />agreement is ever terminated. The uee permit shall not <br />terminate, however, if within sixty (60) days of termination of <br />the agreement, a substitute agreement is presented to and <br />approved by the City Attorney or if construction of the <br />requisite number of spaces is commenced on-site. <br /> <br />(4) Ail improvements shall be constructed in accordance with <br />Exhibit A. <br /> <br />(5) The applicant ehall comply with all applicable codes, <br />ordinancee, and regulations of federal, state and local <br />governments and shall obtain all necessary licenses and <br />permits." <br /> <br />Ayes: Clemons, Epperson, Griffin, Hawks, King, Pitts, Webb <br />Nays: None <br /> <br />CITY MANAGER'S REPORT <br /> <br />93-295 Letter from the City Manager reco~ending adoption of <br />an ordinance to appropriate $1,487,500 from the Public Utilities <br />Capital Improvements Fund for Phase I of the Highland Biltmore <br />Sewer Improvements project, and award of the contracts to the <br />responsible low bidders, Precon Construction Company and T. A. <br />Sheets Mechanical General Contractor. <br /> <br /> "The 1992-97 Capital Improvements Program (CIP) identifies <br />the Highland Biltmore area for future infrastructure <br />improvements. As the first phase of these improvements, this <br />CIP includes funds in prior authorizations for relocation of the <br />existing deteriorated sewer system from the backyards to the <br />streets. The homeowners will be responsibls for the costs of <br />shifting their existing sewer service to our new mains. <br /> <br /> <br />
