July 27,1993 12. C.A. Toler, 1029 Blair Street, representing the NAACP Portsmouth Branch Area 2, spoke on having staff representation at all meetings to answer questions in their specific field. - Unfinished Business ~ CONSENT AGENDA 93-275 - Code amendment, rezoning and use permitS: Motion of Mr. Pitts, and seconded by Mr. Epperson, to adopt the following ordinances and resolution, approved on first reading at the meeting of July 12, 1993, was adopted and by the following vote: (a) ..AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTION 40-62 THEREOF, PERTAINING TO SIGN REGULATION APPEALS." (b) "ZONING AMENDMENT ORDINANCE Z-93-5." (C) "ZONING AMENDMENT ORDINANCE Z-93-6." (D) "ZONING AMENDMENT ORDINANCE Z-93-7." (F) "A RESOLUTION GRANTING A USEPERMIT TO OPERATE A CENTER FOR SENIOR CITIZENS AT 268 OWENS STREET. WHEREAS, Lawrence W. I'AnsOn, Jr., President of the Beazley Foundation, Inc., the property owner, has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia, 1988, as amended, for granting of a use permit to operate a center for senior citizens at 268 Owens ~Street, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the ~ granting of said use permit, with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit hereinafter described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. That the Beazley Foundation, Inc., is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia, 1988, to operate a center for senior citizens at 268 Owens Street, said property being more particularly described as follows:
