Auqust.24, 1993 <br /> <br />16t <br /> <br />(d) The quantity, ¢ size and type of the <br />project's open space and landscaping improvements is sufficient <br />to offset the decreases in dimensional requirements or other <br />deviations from the zoning district in which the project is <br />located; <br /> <br />(e) The project's internal traffic circulation system is <br />adequate to provide for the convenient and safe movement of <br />vehicles and pedestrians, and the project will not cause <br />surrounding streets and roads to exceed their safe capacities; <br /> <br />(f) The quantity, quality, utility and type of the project's <br />community and common facilities are sufficient to offset the <br />decreases in dimensional requirements and other deviations from <br />the zoning district in which the project is located; <br /> <br />(g) The project complies with the standards for approval of a <br />use permit set forth in Section 40-106 of the Code of ~he City <br />of Portsmouth, Virginia; and <br /> <br />(h) The project provides parking, building access and pathways <br />for persons with disabilities in accordance with the <br />requirements of the Americans with Disabilities Act. <br /> <br /> 2. That a group housing use permit for the construction of <br />ninety-six (96) duplex-style condominium or fee simple units on <br />a portion of Tax Map 709, Parcel i is hereby granted to River <br />Pointe Associates, L.L.C., subject to the following terms and <br />conditions: <br /> <br />(a) The group housing project shall be limited to <br />ninety-six (96) condominium or fee simple units in forty-eight <br />(48) buildings. <br /> <br /> (b) The exterior of the condominium units shall be <br />constructed of the same materials and a=chitectural designs and <br />details used in the "Kings Ford" condominium project in <br />Chesapeake, Virginia. Additional models and architectural <br />changes may be approved by the Planning Commission prior to the <br />issuance of a building permit. <br /> <br /> (c) The site layout and landscaping shall be in accordance <br />with Exhibits A and B, attached hereto and made a part hereof. <br />Minor modifications may be made by the Planning Director prior <br />to issuance of building permits. <br /> <br /> (d) A Landscaping Group 2 buffer shall be planted along <br />River Pointe Parkway and River Pointe Drive prior to completion <br />of 25% of the construction. <br /> <br /> (e) The site plan must conform to all requirements of the <br />Chesapeake Bay Preservation Area Overlay Ordinance and the Tree <br />Replacement Ordinance of the Code of the City of Portsmouth. <br /> <br /> (f) The applicant shall preserve and protect existing trees <br />in the Resource Protection Area of the Chesapeake Bay <br />Preservation Area. Only the building footprint area, driveway <br />area and walkway area in the landward fifty (50) feet of the <br />Resource Protection Area may be disturbed. <br /> <br /> (g) The proposed private street in the condominium <br />development shall be thirty (30) feet wide. An agreement, to <br />the satisfaction of the City Attorney, must be executed <br />providing for the maintenance of the private street by the <br />condominium owners association and for the annual collection and <br />placing in reserve of sufficient funds for such purpose. <br /> <br /> <br />
