]6O <br /> <br />Auqust 24, 1993 <br /> <br />"A RESOLUTION GP, ANTING APPROVAL FOR A GROUP HOUSING USE PERMIT <br />(GHP-93-2~ TO PERMIT CONSTRUCTION OF NINETY-SIX (96) DUPLEX <br />STYLE CONDOMINIUM UNITS IN RIVER POINTE ON A PORTION OF TAX MAP <br />709, PARCEL 1. <br /> <br /> WHEREAS, the applicant, River Pointe Associates, L.L.'C., <br />has made application pursuant to Section 40-112 of the Code of <br />the City of Portsmouth, Virginia, 1988, as amended, for the <br />approval and granting of a group housing use permit for the <br />construction of ninety-six (96) duplex-style condominium or fee <br />simple units in River Pointe on a portion of Tax Map 709.. <br />Parcel 1, more particularly described as follows: <br /> <br />GHP-93-2 <br /> <br />Beginning on the west right-of-way line of River Pointe Parkway <br />a distance of 615' more or less south from its intersection <br />with the south right-of-way line of River Pointe Drive; thence <br />west 100' more or less to a point; thence southwesterly 195' <br />more or less to a point; thence northwest 95' more or less to a <br />point; thence northwest 100' more or less to a point; thence <br />northerly 175' more or less to a point; thence southwest 90' <br />more or less to a point; thence southerly 75' more or less to a <br />point; thence south 178' more or less to a point; thence <br />southwesterly 200' more or less to a point; thence <br />southwesterly 335' more or less to a point; thence <br />southeasterly 225' more or less to a point; thence easterly <br />185' more or less to a point; thence northeasterly 215' more or <br />less to a point; thence northeasterly 270' more or less to a <br />point; thence southeasterly 100' more or less to the west <br />right-of-way line of River Pointe Parkway; thence northerly <br />along said right-of-way 125' more or less to a point; thence <br />continuing north along said right-of-way 480' more or less to <br />the point of origin. <br /> <br /> WHEREAS, the Planning Commission has reviewed such <br />application and site plan submitted therewith and has <br />recommended conditional approval of said application; <br /> <br /> WHEREAS, the applicant has been informed that approval of <br />the group housing project pursuant to section 40-116 grants <br />only an exemption from certain requirements for residences as <br />stated in said section and does not constitute a waiver of any <br />other requirement embodied in the Subdivision Ordinance, Zoning <br />Ordinance, Code of the City of Portsmouth, Virginia, or any <br />other applicable local, state or federal law or regulation; and <br /> <br /> WHEREAS, the applicant is aware that building permits or <br />any other required permit will be issued only upon compliance <br />with the ordinances, laws or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> 1. That, coupled with the terms imposed by paragraph 2 <br />herein, the following conditions exist: <br /> <br />(a) The proposed project is compatible with surrOunding land <br />uses. <br /> <br />(b) The density of the project does not exceed the maximum <br />allowable density for the zoning district, and, where <br />applicable, the floor-area ratio of the project does not exceed <br />the maximum allowable floor-area ratio for the zoning district; <br /> <br />(c) The project as a whole conforms to applicable requirements <br />for minimum required floor area for dwelling units, minimum <br />allowable area for dwelling units, maximum allowable area for <br />the number of dwelling units, and the maximum allowable area <br />devoted to residential purposes; <br /> <br /> <br />
