September 28, 1993 WHEREAS, there are located within the boundaries of the proposed track site, public rights-of-way and other public rights and interests which must be closed, vacated, abandoned and released in order that the track may be constructed. NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Portsmouth, Virginia, hereby expresses and makes known its intent to close, vacate, abandon and release, in such manner as prescribed by law any and all public rights-of-way, public rights and interests as may be necessary for the construction and establishment of a horse racing track in that area as shown on the attached exhibit, with such action to be taken at such time as the Virginia Racing Commission grants a license for said track to Virginia Racing Associates, and only after title to said area has vested in the Portsmouth Redevelopment and Housing Authority." Ayes: Clemons, Epperson, Griffin, Hawks, King, Pitts, Webb Nays: None 93-375 - Letter from the City Manager recommending adoption of a resolution authorizing the City Manager to enter into an agreement providing the Portsmouth Redevelopment and Housing Authority an option to purchase the former Academy Park Elementary School site. "The School Board adopted a resolution at its September 16, 1993 meeting in which it declared the site of the former Academy Park Elementary School to be surplus. This site is to be conveyed to the City of Portsmouth pursuant to the terms of the resolution. The Portsmouth Redevelopment and Housing Authority (PRHA) has requested that the City enter into a purchase option agreement with PRHA in the event that the track is licensed by the Virginia Racing Commission. This site is necessary to the establishment of a horse racing track. I, therefore, recommend adoption of this resolution authorizing the City Manager to enter into an option agreement with PRHA. The resolution further provides that the option may be exercised only upon licensure of a horse racing track on this site." Motion by Mr. King, and seconded by Mr. Epperson, to adopt the following resolution and by the folllowing vote: ,.RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN OPTION AGREEMENT WITH PORTSMOUTH REDEVELOPMENT AND HOUSING AUTHORITY AND AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED OF CONVEYANCE TO THE AUTHORITY FOR THE SITE OF THE FORMER ACADEMY PARK ELEMENTARY SCHOOL. WHEREAS, the School Board of the City of Portsmouth, Virginia, has adopted a resolution declaring the site of the former Academy Park Elementary School to be surplus; and WHEREAS, said resolution further authorizes the conveyance of the site to the City of Portsmouth, Virginia; and WHEREAS, said site is necessary for establislunent and operation of a horse racing track.
