September 28, 1993 <br /> <br /> WHEREAS, there are located within the boundaries of the <br />proposed track site, public rights-of-way and other public <br />rights and interests which must be closed, vacated, abandoned <br />and released in order that the track may be constructed. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the Council of the <br /> City of Portsmouth, Virginia, hereby expresses and makes known <br /> its intent to close, vacate, abandon and release, in such <br /> manner as prescribed by law any and all public rights-of-way, <br /> public rights and interests as may be necessary for the <br /> construction and establishment of a horse racing track in that <br /> area as shown on the attached exhibit, with such action to be <br /> taken at such time as the Virginia Racing Commission grants a <br /> license for said track to Virginia Racing Associates, and only <br /> after title to said area has vested in the Portsmouth <br /> Redevelopment and Housing Authority." <br /> <br /> Ayes: Clemons, Epperson, Griffin, Hawks, King, Pitts, Webb <br /> Nays: None <br /> <br /> 93-375 - Letter from the City Manager recommending adoption of <br /> a resolution authorizing the City Manager to enter into an <br /> agreement providing the Portsmouth Redevelopment and Housing <br /> Authority an option to purchase the former Academy Park <br /> Elementary School site. <br /> <br /> "The School Board adopted a resolution at its September <br /> 16, 1993 meeting in which it declared the site of the former <br /> Academy Park Elementary School to be surplus. This site is to <br /> be conveyed to the City of Portsmouth pursuant to the terms of <br /> the resolution. The Portsmouth Redevelopment and Housing <br /> Authority (PRHA) has requested that the City enter into a <br /> purchase option agreement with PRHA in the event that the track <br /> is licensed by the Virginia Racing Commission. <br /> <br /> This site is necessary to the establishment of a horse <br /> racing track. I, therefore, recommend adoption of this <br /> resolution authorizing the City Manager to enter into an option <br /> agreement with PRHA. The resolution further provides that the <br /> option may be exercised only upon licensure of a horse racing <br />track on this site." <br /> <br /> Motion by Mr. King, and seconded by Mr. Epperson, to adopt <br /> the following resolution and by the folllowing vote: <br /> <br /> ,.RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN OPTION <br /> AGREEMENT WITH PORTSMOUTH REDEVELOPMENT AND HOUSING AUTHORITY <br /> AND AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED OF <br /> CONVEYANCE TO THE AUTHORITY FOR THE SITE OF THE FORMER ACADEMY <br /> PARK ELEMENTARY SCHOOL. <br /> <br /> WHEREAS, the School Board of the City of Portsmouth, <br /> Virginia, has adopted a resolution declaring the site of the <br /> former Academy Park Elementary School to be surplus; and <br /> <br /> WHEREAS, said resolution further authorizes the conveyance <br /> of the site to the City of Portsmouth, Virginia; and <br /> <br /> WHEREAS, said site is necessary for establislunent and <br /> operation of a horse racing track. <br /> <br /> <br />
