195 <br /> <br /> September 28, 1993 <br /> <br /> 5. The Mayor, the CityClerk, ~the City Manager, the <br />Director of Finance, the City Attorney and~other appropriate ~ <br />offiCers; employees and agents of the City:are hereby authorized <br />and directed to take all such action and to execute such <br />instruments as shall be deemed by them to be necessary or <br />appropriate to effect the execution and the delivery of the <br />Guarantee in accordance with the terms of this resolution. <br /> <br /> 6, All actions and proceedings heretofore taken by this <br />Council, the City Manager and the other officers, employees, <br />agents and attorneys of the City in connection with the, <br />authorization of the Guarantee, are hereby ratified, confirmed <br />and approved. <br /> <br /> 7. If any section, paragraph, clause or provision of this <br />resolution shall be held invalid or unenforceable for any <br />reason, the invalidity or unenforceability of such section, <br />paragraph, clause or provision shall not affect any of the <br />remaining portions of this resolution. <br /> <br /> 8. All ordinances, resolutions and proceedings in conflict <br />herein, to the extent of such conflict, are hereby repealed. <br /> <br /> 9. This resolution shall take effect upon its adoption." <br /> <br />Ayes: Clemons, Epperson, Griffin, Hawks, King, Pitts, Webb <br />Nays: None <br /> <br />93-374 - Letter from the City Manager recommending adoption of a <br />resolution expressing the intent of the Portsmouth City Council <br />to close all public rights-of-way within the projected horse <br />racing track facility site. <br /> <br /> "The Virginia Racing Commission requires that an <br />application for a license to establish and operate a horse <br />racing track be submitted to it on or before October 1, 1993. <br />In order for the application to be completed, it should show <br />that governmental actions necessary to acquire ownership and <br />control of the site have been taken. This requirement makes it <br />necessary that an expression of intent to close all public <br />rights-of-way within the projected site be made by the Council. <br /> <br /> The.intent expressed in this resolution is that these <br />public rights-of-way will be closed only after the granting of a <br />license to the Virginia Racing Associates by the Com~nission, and <br />only after the Portsmouth Redevelopment and Housing Authority <br />(PRHA) exercises its option to purchase the site for the track. <br />Once closure of the rights-of-way has been accomplished <br />ownership will be passed to PRHA. <br /> <br />I, therefore, recommend the adoption of this resolution." <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Hawks, to adopt <br />the following resolution and by the following vote: <br /> <br />"A RESOLUTION OF THE COUNCIL OF THE CITY OF PORTSMOUTH, VIRGINIA <br />EXPRESSING ITS INTENT TO CLOSE,-VACATE, ABANDON AND RELEASE ALL <br />PUBLIC RIGHTS-OF-WAY AND OTHER PUBLIC RIGHTS AND INTERESTS <br />WITHIN THE AREA OF THE PROPOSED HORSE RACING TRACK. <br /> <br /> WHEREAS, the citizens of the City of Portsmouth by <br />overwhelming vote have by referendum shown public support for a <br />horse racing track in the City of Portsmouth, Virginia; and <br /> <br /> WHEREAS, the Council of the City of Portsmouth, Virginia, <br />acting in accord with the expressed desire of its citizens, has <br />authorized its City Manager to enter into an agreement of intent <br />for the construction of said track; and <br /> <br /> <br />
