Ti,:, CONSTRUCTION OF THiRTY,EIGHT, (38)TOWNltOUSE <br />UNITS ON CANDLELIGHT LANE AND LANTERN WAY ON A PORTION OF TAX <br />Ir,.,_Ap 709, PARCELS 6-14, 46.1 ~ 46.2. <br /> <br /> WHEREAS, the applicant, The Creative Group, Inc., has made <br />application pursuant to Section 40-112 of the Code of the City <br />of Portsmouth, Virginia, 1988, as amended, for the approval and <br />granting of a group housing use permit for the construction of <br />thirty-eight (38) townhouse units on Candlelight Lane and <br />Lantern Way on a portion of Tax Map 709, Parcels 6-14, 46.1 and <br />46.2, described as follows: <br /> <br />GHP-93-~ <br /> <br />Beginning at the northeast intersection of River Pointe Drive <br />and Lantern Way; thence north along the east right-of-way line <br />of Lantern Way 253 feet more or less to a point; thence east <br />114.15 feet to a point; thence southerly 231 feet to a point; <br />thence westerly 107.33 feet to the east right-of-way line of <br />Lantern Way, the point of beginning. <br /> <br />Also, beginning at a point on the east right-of-way line of <br />Candlelight Lane a distance of 233.28 feet northerly and <br />easterly from its intersection with the north right-of-way line <br />of River Pointe Drive; thence continuing easterly along said <br />right-of-way 308.79 feet to a point; thence southerly 112 feet <br />to a point; thence westerly 259.68 feet to a point; thence <br />northwesterly 104.88 feet to the east right-of-way line of <br />Candlelight Lane, the point of beginning. <br /> <br />Also, beginning on the west right-of-way line of Candlelight <br />Lane a distance of 221.30 feet northerly from its intersection <br />with the north right-of-way line of River Pointe Drive; thence <br />northwesterly a distance of 129.91 feet to a point; thence <br />easterly 551.05 feet to a point; thence southeasterly 124 feet <br />to a point; thence southerly 24.65 feet to the west right-of-way <br />line of Candlelight Lane; thence westerly along said <br />right-of-way 493.67 feet to the point of beginning. <br /> <br /> WHEREAS, the Planning Commission has reviewed such <br />application and site plan submitted therewith and has <br />recommended conditional approval of said application; and <br /> <br /> WHEREAS, the applicant has been informed that approval of <br />the group housing project pursuant to Section 40-116 grants only <br />an exemption from certain requirements for residences as stated <br />in said section and does not constitute a waiver of any other <br />requirement embodied in the Subdivision Ordinance, Zoning <br />Ordinance, Code of the City of Portsmouth, Virginia, or any <br />other applicable local, state or federal law or regulation; and <br /> <br /> WHEREAS, the applicant is aware that building permits or <br />any other required permit will be issued only upon compliance <br />with the ordinances, laws or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT REsoLvED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> 1. That coupled with the terms imposed by Paragraph 2 <br />herein the following conditions exist: <br /> <br />(a) The PrOPosed project is compatible with surrounding land <br />uses; <br /> <br /> <br />
