January 23, 2001 <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Whitehurst, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"AN ORDINANCE TO AMEND CHAPTER 2 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY ENACTING A NEW ARTICLE XXVIII THERETO <br />TO ESTABLISH A HISTORY COMMISSION." <br /> <br />Ayes: Benn, Griffin, Moody, Robinett, Whitehurst, Holley <br />Nays: Pitts <br /> <br />01 - 36 - Adoption of an ordinance to amend Chapter 12 of the Code of the City of <br />Portsmouth pertaining to mandatory and optional changes in the public procurement act <br />that have passed in the General Assembly. <br /> <br />Recommendation: <br /> <br />· Adoption of an ordinance to amend Chapter 12 of the Code of the City of <br />Portsmouth, Virginia, (1988) by amending Sections pertaining to Finance. <br /> <br />Purpose and Need: <br /> <br />· Adopting mandatory and optional changes in the public procurement act that have <br />passed in the General Assembly. <br /> <br />Mandatory: <br /> <br />· Ethics in Public Contracting - This section will supplement existing articles and the <br />State and Local Government Conflict of Interests Act. (State Code Sections 11-72 to 80, <br />new.) <br /> <br />· Employment discrimination by contractor on the basis of age, disability or other basis <br />prohibited by state law relating to discrimination in employment." (State Code Section <br />11-51 and adds to City Code Section 12-179) <br /> <br />Optional: <br /> <br />· Small purchases level increased to $50,000 from $15,000 and $30,000 for <br />computers. This change will allow for greater efficiency in the purchasing process and <br />is in line with the majority of the other Hampton Roads cities. (State Code 11-41.F and <br />City Code Section 12-220) <br /> <br />· Single quotation or term contract from any source may be accepted not to exceed <br />$5,000. (State Code 11-41F and City Code Section 12-220/B, new.) <br /> <br />· Protest of award or decision to award modification of existing language that allows <br />bidder or offer or ten days after public notice of the award or the announcement to <br />award. This section gives the bidder or offerer a reasonable time frame to protest while <br />allowing the City to move forward on projects without lengthy delays. (State Code <br />Section 11-66 and City Code Section, new.) <br /> <br />· Increases the dollar limit for modification of fixed priced contracts without advanced <br />approval of City Council from $10,000 to $50,000 or Twenty-five percent, whichever is <br />greater. (State Code Section 11-55 and City Code Section 11-183) <br /> <br />· Professional services shall be procured by Competitive Negotiation, changes <br />threshold to $30,000 from $20,000 threshold. (State Code Section 11-41B, City Code <br />Section 12-278) <br /> <br />Financial Impact: <br /> <br />· No financial impact from passage of this ordinance. <br /> <br /> <br />
