January 23, 2001 <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"AN ORDINANCE TO AMEND CHAPTER 12 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 12-179, 12-183, 12-220, 12- <br />252, AND 12-278 THEREOF AND BY ADOPTING A NEW DIVISION 5 PERTAINING TO <br />PUBLIC PROCUREMENT AND CONTRACTING." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />01 - 37 - New Downtown Parking Garage <br /> <br />Adoption of a resolution authorizing a Development Agreement with <br />Ellis-Gibson Development Company for the construction of a new downtown <br />parking garage, to be located at the southwest intersection of Crawford and <br />London Street <br /> <br />Adoption of a resolution authorizing the assignment of the Development <br />Agreement for the new downtown parking garage to the Portsmouth Parking <br />Authority, and further authorizing a Cooperation Agreement with said <br />authority. <br /> <br />Recommendation: <br /> <br />a) Adoption of a resolution authorizing a Development Agreement with Ellis-Gibson <br />Development Company for the construction of a new downtown parking garage, to be <br />located on the south side of London Street, between London and Queen Streets, and <br />being generally between Crawford Street on the east and Middle Street on the west, to <br />include a moral obligation of the City to pay the annual lease payment for the garage. <br /> <br />b) Adoption of a resolution authorizing the assignment of the Development <br />Agreement for the new downtown parking garage to the Portsmouth Parking Authority, <br />and further authorizing a Cooperation Agreement between the City with said authority. <br /> <br />Purpose and Need: <br /> <br />· This site will be used to construct a new parking facility that is necessary to handle <br />parking needs of the downtown area. <br /> <br />Financial Impact: <br /> <br />· The parking garage will support the development of the downtown area, and the <br />debt of the lease/purchase of the garage will be offset by the revenue generated by <br />monthly rental as well as short-term parking. <br /> <br />1. Mark Geduldig-Yatrofsky, 363 Middle Street, spoke on those displaced during <br /> construction of the garage being given consideration for alternative parking. <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Pitts, to adopt the following <br />resolutions, and was adopted by the following vote: <br /> <br />01-37(A): <br /> <br />"A RESOLUTION AUTHORIZING A DEVELOPMENT AGREEMENT OR CAPITAL <br />LEASE FOR A NEW DOWNTOWN PARKING GARAGE LOCATED ON THE SOUTH <br />SIDE OF LONDON STREET, BETWEEN LONDON AND QUEEN STREETS, AND <br />BEING GENERALLY BETWEEN CRAWFORD STREET ON THE EAST AND MIDDLE <br />STREET ON THE WEST. <br /> <br /> WHEREAS, there is a critical parking shortage in downtown Portsmouth, and <br />that shortage is anticipated to become even more extreme in the coming year; and <br /> <br /> WHEREAS, it is manifestly in the public interest that construction of a new <br />downtown parking garage start at the earliest possible opportunity in order to foster the <br />continued existence and growth of many downtown businesses for which a safe, <br />adequate, and convenient supply of public parking is essential to business survival; and <br /> <br /> <br />
