<br />105 <br /> <br />June 13,2006 <br /> <br />Motion by Mr. Moody, and seconded by Mr. Whitehurst, to approve request to <br />retain a vinyl, picket fence, with the stipulation that it be painted flat black, and four (4) <br />signs be retained at 608 Court Street, and was adopted by the following vote: <br /> <br />Ayes: Moody, Randall, Smith, Whitehurst, Holley <br />Nays: Psi mas <br />Abstain: Heretick (Business interest) <br /> <br />Motion by Ms. Randall, and seconded by Mr. Smith, to go into Closed Meeting <br />pursuant to provisions of Section 2.2-3711 of the Code of Virginia: <br /> <br />to discuss appointments to boards and commissions, pursuant to <br />subsection 1; and <br /> <br />for consultation with legal counsel and staff pertaining to litigation, and <br />also consultation with legal counsel regarding specific legal matters requiring the <br />provision of legal advice, pursuant to subsection 7. <br /> <br />The subject matter of the meeting is appointments to boards and commissions <br />and litigation involving Friendship Temple, also known as the Garden of Prayer. <br /> <br />The purpose of the meeting is to permit confidential discussion of possible <br />appointees and legal strategy toward concluding litigation. <br /> <br />The motion was adopted by the following vote: <br /> <br />Ayes: Moody, Psimas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />Motion by Ms. Randall, and seconded by Mr. Whitehurst, pursuant to Section <br />2.2-3712(0) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br />requirements by the Virginia Freedom of Information Act, and <br /> <br />2. Only such public business matters as were identified in the motion, by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br /> <br />The motion was adopted by unanimous vote. <br /> <br />On motion, meeting adjourned. <br /> <br /> <br />APPROVED- <br />~. ~~ v.J 1\.0 \kt tiL- <br />l <br />Dr. James W.
