<br />April 25. 2006 <br /> <br />10. Alvah Owens, 1604 North Street, asked that those in charge of grass cutting for the <br />City be held to the same level of accountablity as home owners. <br /> <br />11. Martha Ann Creecy, 317 Dinwiddie Street, spoke in opposition to several items <br />contained in Item 06-187 under the City Manager's Report. <br /> <br />12. Jerry Rogers, 4630 West Norfolk Road, made several suggestions to Council as to <br />how they could fund the sound wall at the Maersk exit onto the Western Freeway. <br />He also spoke in opposition to an increase in the real estate tax rate contained in <br />Item 06-187(a) under the City Manager's Report. <br /> <br />13. Pamela Rogers, 4630 West Norfolk Road, asked for help from Council in resolving a <br />stalemate between the Hunters Point Civic League and the Clean Community <br />Commission with regards to restoring the entryway to the Hunters Point Community. <br /> <br />- Unfinished Business - <br /> <br />06 - 165 - Use permits and group housing use permit applications: <br /> <br />Motion by Mr. Whitehurst, and seconded by Ms. Randall, to adopt the following <br />resolution approved on first reading at the April 11 , 2006 meeting, and was adopted by <br />the following vote: <br /> <br />06 - 165(a): <br /> <br />"RESOLUTION GRANTING A USE PERMIT TO SEA SHELL PROPERTIES, INC., TO <br />CONSTRUCT A DUPLEX AT 3501 TYRE NECK ROAD. <br /> <br />WHEREAS, Sea Shell Properties, Inc., has made application pursuant to <br />Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of <br />a use permit to construct a duplex at 3501 Tyre Neck Road, Portsmouth, Virginia; and <br /> <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That it finds that the use for which the permit is sought: <br /> <br />(a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br />(c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br />(d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br />
