<br />April 25. 2006 <br /> <br />(e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That Sea Shell Properties, Inc., is hereby granted a use permit pursuant to <br />Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) to construct a <br />duplex at 3501 Tyre Neck Road, Portsmouth, Virginia, and being more particularly <br />described as: <br /> <br />UP-06-02 <br /> <br />Beginning at the northeast intersection of West Norfolk Road and Tyre Neck Road <br />and thence running north along Tyre Neck Road 80 feet; thence east 125 feet; thence <br />south 80 feet to West Norfolk Road; and thence West along West Norfolk Road 125 feet <br />to the point of beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The project shall be built in general accordance with the site plan, floor <br />plan and elevations submitted on January 23, 2006 and on file in the Office of Planning <br />and Zoning. <br /> <br />(b) The site shall be developed in accordance with the landscaping <br />designated on the site plan submitted to the Office of Planning and Zoning on January <br />23, 2006. <br /> <br />(c) The project shall comply with all applicable codes, ordinances, and <br />regulations of federal, state, and local governments, and all required licenses and <br />permits shall be obtained and remain in effect during the development of the project. <br /> <br />(d) Taxes and fees associated with the property shall be paid when due. <br /> <br />(e) The duplexes shall be built with building materials generally consistent <br />with those submitted to the Office of Planning and Zoning on January 23, 2006. <br /> <br />(f) Parking shall be provided at the rear of the duplex with ingress and egress <br />off of Tyre Neck Road. The City Engineer and the City Zoning Official must approve the <br />parking and driveway. <br /> <br />(g) A six (6) foot vinyl privacy fence shall be erected along the rear of the <br />property. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />Motion by Mr. Moody, and seconded by Ms. Psi mas, to adopt the following <br />resolution approved on first reading at the April 11 , 2006 meeting, and was adopted by <br />the following vote: <br /> <br />06 - 165(b): <br /> <br />"RESOLUTION GRANTING A USE PERMIT TO SEA SHELL PROPERTIES, INC., TO <br />CONSTRUCT A DUPLEX AT 3505 TYRE NECK ROAD. <br />
