April 11. 2006 (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to Insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Blue Horseshoe Tattoo V, Inc., is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) to operate body art studio at 3408 N. George Washington Highway, Portsmouth, Virginia, and being more particularly described as: UP-05-33 All that certain lot, piece or parcel of land, with its appurtenances, situate in the City of Portsmouth, Virginia, and bounded and described according to a plat entitled "Plat of Properties to be Exchanged by Jean M. Davis and P.G. Blanford", duly recorded in the Clerk's Office of Circuit Court of the City of Portsmouth in Map Book 3, page 24, as follows: Beginning at an iron pin on the northwestern side of George Washington Highway distant S. 450 30' 20" W. 199.42 feet measured along said highway from the southern line of the right-of-way of the Norfolk and Portsmouth Beltline Railroad, and from thence running S. 450 27' 30" W. 103.7 feet to an iron pin; thence N. 590 26' W. 185.4 feet to an iron pin; thence N. 450 07' E. 104 feet to a pin; and thence S. 590 26' E. 184.16 feet to the point of beginning.
