<br />April 11. 2006 <br /> <br />(a) Operating hours shall be limited to Monday-Saturday from 10:00 a.m. to <br />1 :00 a.m. and Sunday from 1 :00 p.m. to 9:00 p.m. <br /> <br />(b) Signage, as defined in Section 40-22 of the Zoning Ordinance, for the <br />parcel is limited to 102 square feet total. <br /> <br />(c) Any replacement of or new construction of freestanding signage shall be <br />of a monument style and shall be reviewed and approved by the Department of <br />Planning. <br /> <br />(d) The applicant shall maintain private waste management contracts for both <br />regular commercial trash disposal and bio-waste disposal as approved by the <br />Department of General Services. <br /> <br />(e) The applicant shall be required to provide site improvements, including <br />paving, parking, curbing, and landscaping, in general compliance with the plan <br />submitted (Exhibit A). A site plan review and approval by the Engineering Department <br />is required before construction. <br /> <br />(f) The body art studio shall be operated in compliance with all applicable <br />federal, state, and local codes, ordinances, and regulations. <br /> <br />(g) All required federal, state, and local licenses and permits shall be obtained <br />and maintained in effect during the operation of the studio. <br /> <br />(h) The body art studio shall be operated and maintained in accordance with <br />all required inspections by the City of Portsmouth Fire Department, Health Department, <br />and Building Official. Annual inspections shall be conducted as required. <br /> <br />(i) All taxes and fees associated with the property shall be paid when due <br />and maintained current. <br /> <br />(j) The owners andlor operators of the studio shall not violate any laws of the <br />Commonwealth or ordinances of the City related to peace and good order, nor suffer <br />repeated or chronic violations by any of its patrons or customers. <br /> <br />If the Chief of Police, in his discretion, determines that there are sufficient violations of <br />this type to comprise a significant law enforcement problem, he shall so notify the <br />applicant in writing and shall provide a copy of such notice to the Director of Planning. <br /> <br />If, within six months of the date of such letter, the Director of Planning determines that <br />the offenses against peace and good order are continuing, then he may initiate <br />proceedings for the revocation of this permit. Provided, however, that if such problems <br />are of severity that the Chief of Police determines that there is a significant risk to public <br />safety or peace and good order of such proportions as to create a risk of blight, the <br />revocation proceedings may be initiated by the Director of Planning regardless of the six <br />(6) month requirement which is otherwise applicable. <br /> <br />4.
