<br />April 11. 2006 <br /> <br />(m) The floor plan and operations of this establishment shall comply with the <br />Uniform Statewide Building Code, which shall be addressed prior to the issuance of the <br />Certificate of Occupancy. <br /> <br />(n) The facility shall comply with the Statewide Fire Code, which includes <br />obtaining an official occupancy load certificate. <br /> <br />(0) The applicant shall be responsible for the cost of providing improved <br />waterlsewer services. The facility shall be upgraded with an RPZ backflow preventer <br />downstream of the water meter. <br /> <br />(p) The proposed business shall operate in accordance with all other federal, <br />state and local regulations. <br /> <br />(q) All taxes in connection with the proposed use shall be paid when due. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Whitehurst, Holley <br />Nays: None <br /> <br />Motion by Mr. Whitehurst, and seconded by Ms. Psi mas, to adopt the following <br />resolution approved on first reading at the March 28, 2006 meeting, and was adopted <br />by the following vote: <br /> <br />06 - 139(c) <br /> <br />"RESOLUTION GRANTING APPROVAL OF A GROUP HOUSING USE PERMIT <br />(GHP-06-02) TO 725 HIGH STREET, L.L.C., FOR 28 RESIDENTIAL APARTMENT <br />UNITS AT 723 AND 725 HIGH STREET AND 714 KING STREET. <br /> <br />WHEREAS, 725 High Street, L.L.C., pursuant to Section 40-112 of the Code of <br />the City of Portsmouth, Virginia (1988), as amended, has made application for the <br />approval and granting of a group housing use permit for 28 residential apartment units <br />at 723 and 725 High Street and 714 King Street, Portsmouth, Virginia; and <br /> <br />WHEREAS, the subject property is furthermore described as: <br /> <br />GHP-06-02 <br /> <br />723 High Street <br /> <br />All that certain lot, piece or parcel of land, with its appurtenances, situate in the <br />City of Portsmouth, Virginia, and being bounded and described as follows, to-wit: <br />Beginning at a point on the south side of High Street 180 feet west of the <br />southwest intersection of High Street and Green Street and from thence running <br />west along the south side of High Street eight 8 feet, more or less, to the brick <br />building of S. Lasting; thence south along the line of said brick building 113 feet; <br />thence east eight feet, more or less, and thence north 113 feet to the point of <br />beginning. <br />
