That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) <br />patrons. <br /> <br />The establishment shall be limited to no more than forty-eight (48) <br /> <br />(b) The use shall adhere to City Code Section 40-52.1 (b), which outlines <br />requirements for limited service social establishments. <br /> <br />(c) The garden area shall be permitted for use for outdoor social gatherings. <br /> <br />(d) In order to ensure the maintenance of peace and good order, hours of <br />operation include a closing hour of 10:00 p.m. Sunday through Thursday with outside <br />music ending at 8:00 p.m. and a closing hour of 11 :00 p.m. Friday and Saturday with <br />outside music ending at 10:00 p.m. <br /> <br />(e) The applicant shall not violate any laws of the Commonwealth or <br />ordinances of the City related to peace and good order, nor suffer repeated chronic <br />violations by any of its patrons or customers. If the Chief of Police, in his discretion, <br />determines that there are sufficient violations of this type to comprise a significant law <br />enforcement problem, then he shall so notify the applicant in writing and shall offer to <br />meet to provide advice on how to lessen and avoid repeated offenses against peace <br />and good order. A copy of this letter shall be provided to the Director of Planning. If, <br />within six months of the date of this letter, said Director, in his discretion, determines <br />that offenses against peace and good order are continuing, then he may initiate <br />proceedings for the revocation of this permit. Provided, however, that if problems of <br />peace and good order are of such severity that the Chief of Police determines that there <br />is a significant risk to public safety or peace and good order or such properties as to <br />create a risk of blight, then revocation proceedings may be initiated by the Director <br />without regard to the six month requirement which is otherwise required. <br /> <br />(f) The establishment shall not be utilized for regular meetings. <br /> <br />(g) All exterior improvements, including signage, shall be reviewed and <br />approved by the Commission of Architectural Review. <br /> <br />(h) Signage shall be limited to one wall sign not to exceed four square feet. <br />Such sign shall not be illuminated and shall meet all zoning requirements including the <br />issuance of an appropriate permit. <br /> <br />(i) The applicant shall obtain a Parking Exception for the required 12 off- <br />street parking spaces. On-site parking shall be limited to the support staff only. <br /> <br />(j) During an event, the applicant shall erect a sign at the entrance of the Red <br />Lion parking lot that informs function attendees that no parking is allowed in the Red <br />Lion lot. The sign shall be at least large enough to be easily read and shall be approved <br />by the City Engineer. <br /> <br />(k) The applicant shall maintain the existing landscaping and tree canopy in <br />order to comply with the required 10% tree canopy coverage. <br /> <br />(I) The applicant shall comply with the plan to utilize City trash collection <br />services approved by the Department of General Services on January 6, 2006. <br />
