<br />That certain lot, piece or parcel of land, with the buildings and improvements
<br />thereon, and the appurtenances thereunto belonging, situate on the south side of
<br />High Street, between Effingham Street and Green Street, in the City of
<br />Portsmouth, Virginia, bounded and described as follows: Beginning 135 feet
<br />east from the southeast intersection of Effingham Street with High Street; thence
<br />east along High Street 45 feet; thence south 113 feet; thence west 45 feet; and
<br />thence north 113 feet to the point of beginning.

<br />It being the same property conveyed to M. M. Crockin Company, Inc., a Virginia
<br />corporation by deed from Hyman B. Lasting and Edna Lasting, his wife, Sol
<br />Lasting and Elizabeth Lasting, his wife, Leon Lasting and Kathryn Lasting, his
<br />wife, Rose L. Kanter, widow, Flossie L. Rosen, widow, Isabelle R. Lasting, wife of
<br />Philip Lasting, and Leonard G. Karp and Isabelle R. Lasting, Executors of the
<br />Estate of Philip Lasting, deceased dated January 2, 1975 and recorded January
<br />2, 1975 in the Clerk's Office of the Circuit Court of the City of Portsmouth,
<br />Virginia in Deed Book 658 at page 127.

<br />That certain lot of land, with the buildings thereon and the appurtenances thereto
<br />belonging, situate in the City of Portsmouth, Virginia, and bounded as follows:
<br />Beginning 102 feet from the northeast intersection of King and Effingham Streets,
<br />on the north side of King Street; thence running north along the line of the
<br />property now or formerly owned by Wm. S. Cooke 113 feet; thence east, parallel
<br />with King Street, 78 feet; thence south, parallel with Effingham Street, 113 feet to
<br />King Street; and thence west along King Street 78 feet to the point of beginning
<br />on the line of Wm. S. Cooke.

<br />It being the same property conveyed to M. M. Crockin Company, Inc., a Virginia
<br />corporation, by deed from S. Lasting and Brother, Incorporated, a Virginia
<br />corporation, dated May 30, 1974 and recorded June 7, 1974, which is recorded
<br />in the Clerk's Office of the City of Portsmouth, Virginia, in Deed Book 647 at page
<br />708.

<br />WHEREAS, the Planning Commission has reviewed such application and site
<br />plan submitted therewith and has recommended conditional approval of said
<br />application; and
<br />
<br />WHEREAS, the applicant has been informed that approval of the group housing
<br />project pursuant to Section 40-116 only grants an exemption from certain requirements
<br />for residences as stated in said section and does not constitute a waiver of any other
<br />requirement embodied in the Subdivision Ordinance, Zoning Ordinance, Code of the
<br />City of Portsmouth, Virginia, or any other applicable local, state or federal law or
<br />regulation; and
<br />
<br />WHEREAS, the applicant is aware that building permits and any other required
<br />permit will be issued only upon compliance with the ordinances, laws or regulations
<br />applicable thereto.
