Estimated Net Proceeds $378,255.00 <br /> <br />Staff Recommends: <br />Adoption of an ordinance to Authorize and Appropriate $209,245.00 in the Public <br />Utilities Capital Improvements Program Budget for expenses related to the sale of <br />timber, clearing, erosion protection, reforestation, and updating the timber management <br />plan. Source of the funding will be from timber sales proceeds. Vision Principle: Bold <br />New Directions. <br /> <br />Next Steps following City Council Action: <br />. The Department of Public UtilitieslWorks, through its Watershed Superintendent, <br />will exercise oversight over the sale, manage the clearing and reforestation effort, and <br />the development of the Forest Stewardship Program Update. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Whitehurst, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE TO APPROPRIATE $209,245 IN THE PUBLIC UTILITIES CAPITAL <br />IMPROVEMENTS FUND FOR EXPENSES RELATED TO TIMBER MANAGEMENT <br />ON DAM AND WATERSHED PROPERTIES MANAGED BY THE DEPARTMENT OF <br />PUBLIC UTILITIES." <br /> <br />Ayes: Heretick, Moody, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />06 - 49 - Adoption of an ordinance to amend City Code Section 17-26(a)(c) to <br />incorporate language from State Code 36-106 as it pertains to penalty for violation of <br />the Housing Code. Vision Principle: Neighborhood and Community Transformation. <br /> <br />Background: <br />. There are no penalty provisions currently in Section 17-26 for second and third <br />offenses of the State Housing Code. Currently owners who are tried and convicted pay <br />fines and property remains in violation. The Inspector has to start the process over, <br />beginning with a new notice of violation. By incorporating the additional language into <br />Section 17-26, a stronger message will be sent to owners who may be repeat offenders. <br /> <br />Discussion: <br />. State Code 36-106 allows increased penalty amounts for repeat violation of the <br />Housing Code involving the same property. Second offenses, if convicted, could result <br />in a fine of no less than $500 or more than $2500. Third offenses if convicted could <br />result in confinement of no more than 10 days and a fine of no less than $2500 or more <br />than $5,000, either or both. No portion of the fine for third or subsequent offense shall <br />be suspended. <br />. Financial Impact: No financial impact on the City <br /> <br />Staff Recommends: <br />Adoption of an ordinance to amend City Code Section 17 -26(a)(c) to incorporate <br />language from State Code 36-106 as it pertains to penalty for violation of the Housing <br />Code.
