December 13, 2005 <br /> <br />? <br /> There are currently sixteen Portsmouth taxpayers who are responsible for <br />admissions tax. <br />? <br />Financial Impact: <br /> There may be an initial non-material loss of revenue, but it is <br />likely to be offset by greater admissions resulting from a more modern tax structure and <br />elimination of a regional competitive disadvantage. <br /> <br />Staff Recommends: <br />Adoption of an Ordinance to amend Chapter 35 of the City Code, by amending Section <br />35-372 and by repealing Sections 35-373 through 35-375, pertaining to the calculation <br />and application of admissions tax. Vision Principle: A Robust and Prospering Economy. <br /> <br />Next Steps Following Council Action: <br />? <br /> <br /> Implementation by Commissioner of Revenue. <br /> <br />Motion by Ms. Psimas, and seconded by Ms. Randall, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE TO AMEND CHAPTER 35 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTION 35-372 AND BY <br />REPEALING SECTIONS 35-373 THROUGH 35-375 THEREOF PERTAINING TO THE <br />CALCULATION AND APPLICATION OF ADMISSIONS TAX.” <br /> <br />Ayes: Heretick, Moody, Psimas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />05 - 573 - Adoption of an ordinance to amend Chapter 32 of the City Code to allow “A” <br />and “T” signs to be placed on the public right-of-way in the downtown area as long as <br />certain conditions are met. Vision Principle: Neighborhood and Community <br />Transformation. <br /> <br />Background: <br />? <br /> As the result of recent enforcement actions, the City Council received complaints <br />concerning the current codes. <br />? <br /> Staff reviewed several sections of the City Code (Chapter 40 and Chapter 32) <br />and proposed this change in concert with changes to the Zoning Ordinance that are <br />currently before the City Council for final approval. <br /> <br />Discussion: <br />? <br /> Zoning Ordinances should not be used to regulate any activity on public right-of- <br />ways. <br />? <br /> Chapter 32 of the City Code (Streets and Sidewalks) is the correct authority for <br />this type of regulation and enforcement. <br />? <br /> Because of the unique nature of the downtown area a blanket prohibition against <br />signs in the public right-of-way is not desired, but there is a need for limitations. <br />? <br />Financial Impact: <br /> There will be no financial impact on the City. <br /> <br />Staff Recommends: <br />Adoption of an Ordinance to amend Chapter 32 of the City Code to allow “A” and “T” <br />signs to be placed on the public right-of-way in the downtown area as long as certain <br />conditions are met. Vision Principle: Neighborhood and Community Transformation. <br /> <br />Next Steps Following Council Action: <br />? <br /> Education of the downtown merchants as to the number, type and sign size that <br />will be permitted. <br />? <br /> City Engineer to prepare a letter authorizing the Environmental Inspectors to <br />serve as his agents in enforcement actions, if necessary. <br /> <br />Motion by Mr. Moody, and seconded by Ms. Randall, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
