December 13, 2005 <br /> <br />“ORDINANCE TO AMEND CHAPTER 32 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTION 32-8 THEREOF <br />PERTAINING TO SIDEWALK SIGNS IN THE DOWNTOWN D-1 PUBLIC RIGHT OF <br />WAY.” <br /> <br />Ayes: Heretick, Moody, Psimas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />05 - 574 - Adoption of an ordinance to amend Chapter 22 of the City Code by <br />prohibiting the parking of unlicensed vehicles on the public right-of-way and provide for <br />the immediate issuance of a parking ticket for such violations. Vision Principle: <br />Neighborhood and Community Transformation. <br /> <br />Background: <br />? <br /> For the past several months staff has been preparing changes to Chapter 22, <br />which would provide for aggressive enforcement on the parking of certain vehicles. <br />? <br /> These changes were proposed to cover four issues. <br />? <br /> After the November 15, 2005 Public Information Meeting the only issue without <br />the need for additional study was the issue of unlicensed vehicles on the public right-of- <br />way. <br /> <br />Discussion: <br />? <br /> Currently, if an unlicensed vehicle is discovered parked on the public street the <br />Police Department must wait 72 hours and observe that the vehicle has not moved. <br />? <br /> This waiting period often allows these vehicles time to be moved between the <br />street and the yard in an effort to delay enforcement. <br />? <br /> This is one of the four parking issues that has been discussed with City Council <br />and is the one issue that has developed no negative comments from the public. <br /> <br />Staff Recommends: <br />Adoption of an ordinance to amend Chapter 22 of the City Code by prohibiting the <br />parking of unlicensed vehicles on the public right-of-way and provide for the immediate <br />issuance of a parking ticket for such violations. Vision Principle: Neighborhood and <br />Community Transformation. <br /> <br />Next Steps Following Council Action: <br />? <br /> Police Department will provide notification to officers as to the change. <br />? <br /> Change in the regulations to be advertised on Channel 48. <br />? <br /> Tickets for these violations to begin being issued February 1, 2006. <br /> <br />Motion by Mr. Whitehurst, and seconded by Ms. Psimas, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE TO AMEND CHAPTER 22 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTION 22-562 TO PROHIBIT <br />THE PARKING OF UNLICENSED MOTOR VEHICLES ON THE PUBLIC RIGHT-OF- <br />WAY.” <br /> <br />Ayes: Heretick, Moody, Psimas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />05 - 575 - Adoption of an ordinance to reprogram funds totaling $3,343,000 within the <br />2005-2006 Capital Improvements Fund for various capital projects.
