December 13, 2005 <br />WHEREAS, <br />this Council is cognizant of the conditions that are imposed by the <br />provisions of the Housing and Community Development Act of 1974, as amended, <br />including those prohibiting discrimination because of race, age, color, religion, familial <br />status, handicap, sex or national origin; and <br />WHEREAS, <br />in the judgment of this Council, it is in the interest of the City and <br />its inhabitants that said Plan be approved. <br />NOW, THEREFORE, BE IT RESOLVED <br />by the Council of the City of <br />Portsmouth, Virginia: <br />1. That it is hereby found and determined that the Project Area is blighted <br />pursuant to Chapter 1 of the Title 36 of the Code of Virginia, 1950, as amended (the <br />"Act"). <br />2. That regarding the adoption of the Redevelopment Plan for the Centre <br />Avenue/Oak Street Redevelopment Project, it is hereby found: <br />(a) That the objectives of the Centre Avenue/Oak Street Redevelopment <br />Project, Portsmouth, Virginia, can be better achieved by the adoption of the Plan; and <br />(b) That the Plan meets the requirements of a plan for a redevelopment <br />project pursuant to the Act. <br />3. That the Centre Avenue/Oak Street Redevelopment Plan for the <br />Centre Avenue/Oak Street Redevelopment Project, having been duly reviewed <br />and considered, is hereby approved and adopted, and the City Clerk is hereby <br />directed to file a copy of said Plan with the minutes of this meeting.” <br /> <br />“ORDINANCE APPROPRIATING IN THE 2005-2006 COMMUNITY PLANNING AND <br />DEVELOPMENT PROGRAM FUND $168,224 OF EXCESS CDBG PROGRAM <br />INCOME RECEIVED IN FY 2005 TO BE USED FOR THE ACQUISITION OF <br />PROPERTIES IDENTIFIED IN THE CENTRE AVENUE/OAK STREET <br />REDEVELOPMENT PLAN.” <br /> <br />Ayes: Heretick, Moody, Psimas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />05 - 572 - Adoption of an ordinance to amend Chapter 35 of the City Code, by <br />amending Section 35-372 and by repealing Sections 35-373 through 35-375, pertaining <br />to the calculation and application of admissions tax. Vision Principle: A Robust and <br />Prospering Economy. <br /> <br />Background: <br />? <br /> In previous years, it has been the common practice for admissions tax to be <br />charged on complimentary tickets. Other cities in the region have changed this <br />practice, and today Portsmouth is the only city in the region still doing so. This tax is <br />often difficult to assess and to calculate, it places undue burdens on operators. <br />Additionally, it puts Portsmouth at a competitive disadvantage for booking entertainment <br />in the region. <br /> <br />Discussion: <br />? <br /> The admissions tax on complimentary tickets will be repealed, prospectively only. <br />? <br /> There will be no effect on prior assessments of, and responsibility for, admissions <br />tax on complimentary tickets. <br />? <br /> Inapplicable and unneeded exemptions, such as the exemption for city officials <br />who work at entertainment functions, exempting federal tax from the basis for <br />calculating admissions tax, and exempting admissions tax on admissions under ten <br />cents, will be repealed. <br />? <br /> The impractical and unenforceable exemption for tickets sold to persons under <br />twelve will be repealed. <br />? <br /> The Commissioner of Revenue has recommended this action. <br /> <br /> <br /> <br /> <br />
