November 8. 2005 (k) An additional door shall be installed at the rear of the building to provide direct ingress and egress from the rear of the building to the outdoor play area. (I) No on-street parking for drop off / pick up of children associated with the child care center shall be permitted. (m) A site plan review and approval by the Department of Engineering shall be required. (n) The existing landscaping shall remain and be maintained. Any replacement shall be made in kind. (0) Refuse collection shall be by the City of Portsmouth as approved by the Director of General Services. (p) The center shall be operated and maintained in accordance with all required inspections by the City Fire Department, Public Health Department, and Building Official and shall include annual inspections, as required. (q) The center shall be operated in compliance with all applicable codes, ordinances, and regulations of federal, state, and local governments, and all required licenses and permits shall be obtained and maintained in effect during the operation of the center. (r) Taxes and fees associated with the property shall be paid when due. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." Ayes: Heretick, Moody, Randall, Smith, Whitehurst, Holley Nays: None Councilwoman Psimas was absent during the vote. 05 - 465 - Use permit: Motion by Mr. Whitehurst, and seconded by Mr. Moody. to adopt the following resolution approved on first reading at the October 11, 2005 meeting, and was adopted by the following vote: 05 - 465(b): "RESOLUTION GRANTING A USE PERMIT TO GLEN W. ESTES, JR., TO OPERATE A BODY ART STUDIO AT 5200B GEORGE WASHINGTON HIGHWAY. WHEREAS, Glen W. Estes, Jr., has made application pursuant to Section 40- 43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate a body art studio at 5200B George Washington Highway, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That it finds that the use for which the permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood;
