<br />November 8. 2005 <br /> <br />(k) An additional door shall be installed at the rear of the building to provide <br />direct ingress and egress from the rear of the building to the outdoor play area. <br /> <br />(I) No on-street parking for drop off / pick up of children associated with the <br />child care center shall be permitted. <br /> <br />(m) A site plan review and approval by the Department of Engineering shall be <br />required. <br /> <br />(n) The existing landscaping shall remain and be maintained. Any <br />replacement shall be made in kind. <br /> <br />(0) Refuse collection shall be by the City of Portsmouth as approved by the <br />Director of General Services. <br /> <br />(p) The center shall be operated and maintained in accordance with all <br />required inspections by the City Fire Department, Public Health Department, and <br />Building Official and shall include annual inspections, as required. <br /> <br />(q) The center shall be operated in compliance with all applicable codes, <br />ordinances, and regulations of federal, state, and local governments, and all required <br />licenses and permits shall be obtained and maintained in effect during the operation of <br />the center. <br /> <br />(r) Taxes and fees associated with the property shall be paid when due. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Heretick, Moody, Randall, Smith, Whitehurst, Holley <br />Nays: None <br />Councilwoman Psimas was absent during the vote. <br /> <br />05 - 465 - Use permit: <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Moody. to adopt the following <br />resolution approved on first reading at the October 11, 2005 meeting, and was adopted <br />by the following vote: <br /> <br />05 - 465(b): <br /> <br />"RESOLUTION GRANTING A USE PERMIT TO GLEN W. ESTES, JR., TO <br />OPERATE A BODY ART STUDIO AT 5200B GEORGE WASHINGTON HIGHWAY. <br /> <br />WHEREAS, Glen W. Estes, Jr., has made application pursuant to Section 40- <br />43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use <br />permit to operate a body art studio at 5200B George Washington Highway, Portsmouth, <br />Virginia; and <br /> <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That it finds that the use for which the permit is sought: <br /> <br />(a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br />
