<br />November 8. 2005 <br /> <br />(c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br />(d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br />(e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That Glen W. Estes, Jr., is hereby granted a use permit pursuant to Section <br />40-43.1 of the Code of the City of Portsmouth, Virginia (1988) to operate body art studio <br />at 5200B George Washington Highway, Portsmouth, Virginia, and being more <br />particularly described as: <br /> <br />UP-05-28 <br /> <br />Beginning at a point on the west side of George Washington <br />Highway, approximately 52 feet +/- north of the intersection <br />of George Washington Highway and the City of Chesapeake <br />boundary line; thence in a westerly direction approximately <br />360 feet +/- to a point; thence in a northerly direction 115 <br />feet +/- to a point; thence in a easterly direction <br />approximately 360 feet +/- to a point, thence in a southerly <br />direction approximately 115 feet +/- to the point of beginning; <br />and including the rear portion only of the existing building <br />located on such. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) Operating hours shall be limited to 10:00 a.m. to 1:00 a.m., Monday <br />through Saturday, and 1 :00 p.m. to 9:00 p.m. on Sunday. <br /> <br />(b) Signage for the parcel is limited to 115 square feet total to serve all uses. <br /> <br />(c) Any replacement of or new construction of free-standing signage shall be <br />of a monument style and shall be reviewed and approved by the Department of <br />Planning. <br /> <br />(d) The applicant shall maintain private waste management contracts for both <br />regular commercial trash disposal and bio-waste disposal as approved by General <br />Services. <br /> <br />(e) The applicant shall install site improvements, including paving, parking, <br />curbing, and landscaping, in compliance with his submitted plan on file in the Office of <br />Planning and Zoning. A site plan review and approval by the Engineering Department <br />is required before construction. <br /> <br />(f) The body art studio shall be operated in compliance with all applicable <br />federal, state, and local codes, ordinances, and regulations. <br /> <br />(g) All required federal, state, and local licenses and permits shall be obtained <br />and maintained in effect during the operation of the business. <br /> <br />(h) The body art studio shall be operated and maintained in accordance with <br />all required inspections by the City of Portsmouth Fire Department, Public Health <br />Department, and Building Official. Annual inspections shall be conducted as required. <br /> <br />(i) All taxes and fees associated with the property shall be paid when due <br />and maintained current. <br /> <br />(j) The owners and/or operators of the establishment shall not violate any <br />laws of the Commonwealth or ordinances of the City related to peace and good order, <br />nor suffer repeated or chronic violations by any of its patrons or customers. <br />
