November 8. 2005 (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Glen W. Estes, Jr., is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) to operate body art studio at 5200B George Washington Highway, Portsmouth, Virginia, and being more particularly described as: UP-05-28 Beginning at a point on the west side of George Washington Highway, approximately 52 feet +/- north of the intersection of George Washington Highway and the City of Chesapeake boundary line; thence in a westerly direction approximately 360 feet +/- to a point; thence in a northerly direction 115 feet +/- to a point; thence in a easterly direction approximately 360 feet +/- to a point, thence in a southerly direction approximately 115 feet +/- to the point of beginning; and including the rear portion only of the existing building located on such. 3. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) Operating hours shall be limited to 10:00 a.m. to 1:00 a.m., Monday through Saturday, and 1 :00 p.m. to 9:00 p.m. on Sunday. (b) Signage for the parcel is limited to 115 square feet total to serve all uses. (c) Any replacement of or new construction of free-standing signage shall be of a monument style and shall be reviewed and approved by the Department of Planning. (d) The applicant shall maintain private waste management contracts for both regular commercial trash disposal and bio-waste disposal as approved by General Services. (e) The applicant shall install site improvements, including paving, parking, curbing, and landscaping, in compliance with his submitted plan on file in the Office of Planning and Zoning. A site plan review and approval by the Engineering Department is required before construction. (f) The body art studio shall be operated in compliance with all applicable federal, state, and local codes, ordinances, and regulations. (g) All required federal, state, and local licenses and permits shall be obtained and maintained in effect during the operation of the business. (h) The body art studio shall be operated and maintained in accordance with all required inspections by the City of Portsmouth Fire Department, Public Health Department, and Building Official. Annual inspections shall be conducted as required. (i) All taxes and fees associated with the property shall be paid when due and maintained current. (j) The owners and/or operators of the establishment shall not violate any laws of the Commonwealth or ordinances of the City related to peace and good order, nor suffer repeated or chronic violations by any of its patrons or customers.
