<br />November 8. 2005 <br /> <br />(d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br />(e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That LaVern Theus is hereby granted a use permit pursuant to Section 40- <br />43.1 of the Code of the City of Portsmouth, Virginia (1988) to operate a child care center <br />at 601 Washington Street and 531 King Street, and being more particularly described <br />as: <br /> <br />UP-05-26 <br /> <br />Parcel One: Beginning at the southeast intersection of <br />Washington and King Streets; thence south along the east <br />side of Washington Street twenty-six (26) feet; thence east <br />and parallel with King Street ninety (90) feet; thence north <br />and parallel with Washington Street twenty-six feet; and <br />thence west along the south side of King Street ninety (90) <br />feet to the point of beginning. <br /> <br />Parcel Two: Beginning at a point on the south side of King <br />Street, ninety (90) feet east of the southeast intersection of <br />King and Washington Streets; thence east sixty (60) feet to a <br />point; thence south seventy and five tenths (70.5) feet; <br />thence west sixty (60) feet; and thence north seventy and <br />five tenths (70.5) feet to the point of beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The maximum occupancy of the child care center shall not exceed forty- <br />two (42) children at anyone time. <br /> <br />(b) The age range of the children shall be from two to five years. <br /> <br />(c) The days and hours of operation shall be Monday through Friday, 6:00 <br />a.m. to 6:00 p.m. <br /> <br />(d) Outdoor play hours shall be limited to the hours between 8:00 a.m. and <br /> <br />dusk. <br /> <br />(e) The applicant shall comply with the submitted floor and site plans dated <br />received August 15, 2005, except as modified herein. <br /> <br />(f) The 4,200 square foot play area shall be maintained and shall be <br />enclosed with fencing that is at least four (4) feet in height. <br /> <br />(g) The outdoor play area shall be graded and level on all parts with no area <br />having a slope greater than one foot of rise for twelve feet of run. <br /> <br />(h) The applicant shall provide a child-friendly surface for the play area (i.e. <br />rubberized mulch). <br /> <br />(i) The applicant shall provide a minimum of four (4) off-street parking spaces <br />for drop off and pick up. These spaces shall be located at the rear of The New St. Mark <br />Church of God In Christ property fronting 609 and 615 Washington Street. If the <br />parking agreement is terminated, the applicant shall immediately notify the City. The <br />applicant shall provide comparable off-street parking and shall notify the City within <br />thirty (30) days of its new parking arrangements. <br /> <br />(j) An access gate shall be established from the specified off-street parking <br />area to the play area. <br />
