November 8. 2005 2. J. Brewer Moore, 308 Bobby Jones Drive, encouraged Council and citizens to participate in the salute of the Grand Union Flag and in the remembrance of Portsmouth under Five Flags on New Years Eve. 3. Patricia Edgerton, 4504 West Norfolk Road, voiced her concerns regarding Maersk APM Terminals and funding appropriations. 4. Allen Eisenpress, 4634 West Norfolk Road, voiced his concerns on the impact the Maersk Terminals will have on the quality of life in his community. 5. Pamela Rogers, 4630 West Norfolk Road, voiced her concerns on the impact the construction of the Maersk Terminals has had on the community. 6. Stephen Whitehead, 4419 County Street, voiced his frustrations with the lack of response from City Staff in regards to his continued complaint of a poorly repaired pot hole on his street. 7. Raleigh Harsley. 2124 Peach Street, voiced his concerns with regards to various issues in his community. 8. Mark Geduldig-Yatrofsky, 363 Middle Street, voiced his concerns with the Ntelos RFP (Request for Proposal) process. 9. Reverend Diane Jenkins, 347 Chautauqua Avenue, read to Council her affidavit of complaint against the Commission of Architectural Review II. - Unfinished Business - 05 - 465 - Use permit: Motion by Mr. Moody, and seconded by Mr. Whitehust. to adopt the following resolution approved on first reading at the October 11, 2005 meeting, and was adopted by the following vote: 05 - 465(a): "RESOLUTION GRANTING A USE PERMIT TO LA VERN THEUS TO OPERATE A CHILD CARE CENTER AT 601 WASHINGTON STREET AND 531 KING STREET. WHEREAS, LaVern Theus has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate a child care center at 601 Washington Street and 531 King Street, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That it finds that the use for which the permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses;
