<br />November 8. 2005 <br /> <br />2. J. Brewer Moore, 308 Bobby Jones Drive, encouraged Council and citizens to <br />participate in the salute of the Grand Union Flag and in the remembrance of <br />Portsmouth under Five Flags on New Years Eve. <br /> <br />3. Patricia Edgerton, 4504 West Norfolk Road, voiced her concerns regarding Maersk <br />APM Terminals and funding appropriations. <br /> <br />4. Allen Eisenpress, 4634 West Norfolk Road, voiced his concerns on the impact the <br />Maersk Terminals will have on the quality of life in his community. <br /> <br />5. Pamela Rogers, 4630 West Norfolk Road, voiced her concerns on the impact the <br />construction of the Maersk Terminals has had on the community. <br /> <br />6. Stephen Whitehead, 4419 County Street, voiced his frustrations with the lack of <br />response from City Staff in regards to his continued complaint of a poorly repaired <br />pot hole on his street. <br /> <br />7. Raleigh Harsley. 2124 Peach Street, voiced his concerns with regards to various <br />issues in his community. <br /> <br />8. Mark Geduldig-Yatrofsky, 363 Middle Street, voiced his concerns with the Ntelos <br />RFP (Request for Proposal) process. <br /> <br />9. Reverend Diane Jenkins, 347 Chautauqua Avenue, read to Council her affidavit of <br />complaint against the Commission of Architectural Review II. <br /> <br />- Unfinished Business - <br /> <br />05 - 465 - Use permit: <br /> <br />Motion by Mr. Moody, and seconded by Mr. Whitehust. to adopt the following <br />resolution approved on first reading at the October 11, 2005 meeting, and was adopted <br />by the following vote: <br /> <br />05 - 465(a): <br /> <br />"RESOLUTION GRANTING A USE PERMIT TO LA VERN THEUS TO OPERATE A <br />CHILD CARE CENTER AT 601 WASHINGTON STREET AND 531 KING STREET. <br /> <br />WHEREAS, LaVern Theus has made application pursuant to Section 40-43.1 <br />of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to <br />operate a child care center at 601 Washington Street and 531 King Street, Portsmouth, <br />Virginia; and <br /> <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That it finds that the use for which the permit is sought: <br /> <br />(a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br />(c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br />
