<br />CITY MANAGER'S REPORT
<br />
<br />94-12 Letter from the City Manager recommending adoption of
<br />an ordinance to amend Chapter 38 of the Code of the City of
<br />Portsmouth, Virginia, 1988, by amending Sections 38-I66(b),
<br />38-168(b), (c) & (d), 38-170 through 38-174, 38-179(c) (1),
<br />38-181, 38-185(a), 38-186(c), and 38-187[a) pertaining to
<br />water, sewers and sewer disposal.
<br />
<br /> "Since 1973, Portsmouth has enforced a Backflow Prevention
<br />and Cross Connection Control Program to preclude the entry of
<br />contaminated water into the City's water mains. This program is
<br />required by the Con~nonwealth of Virginia Waterworks
<br />Regulations.
<br />
<br /> Recent changes to the Waterworks and a review of the
<br />current Portsmouth Ordinance by the State Health Department has
<br />prompted the Director of Public Utilities to request minor
<br />revisions to the Code. These changes have been reviewed by
<br />department staff and by the City Attorney's staff.
<br />
<br /> I concur with the request for these minor changes and
<br />recommend your adoption of the revised ordinance."

<br /> "AN ORDINANCE TO AMEND CHAPTER 38 OF THE CODE OF THE CITY
<br />OF PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 38-166(B),
<br />38-168(B), (C) a (D), 38-170 THROUGH 38-174, 38-179(C) (1),
<br />38-181, 38-185(A), 38-186 (C), AND 38-187(A) PERTAINING TO
<br />WATER, SEWERS AND SEWER DISPOSAL."

<br />94-13 Letter from the City Manager recommending adoption of
<br />resolution to vacate a portion of a closed alley in the 800
<br />block of Florida Avenue.
<br />
<br /> ,,Port Norfolk Associates as planning to expand its
<br />building at 807 Florida Avenue. A portion of this expanded
<br />building will be erected in an area that is a closed alley.
<br />When the alley was closed, an easement for public utilities was
<br />reserved in perpetuity. In order to accommodate this
<br />expansion, it is necessary to release and vacate a portion of
<br />the City's reserved easement to the rear of 807 Florida Avenue.
<br />An easement of 15 feet will be obtained adjacent to their
<br />northern property line, and the sewer line will be re-routed.
<br />
<br /> I recommend adoption of this resolution authorizing the
<br />City Manager to release and vacate a portion of the City's
<br />easement in order to provide for this expansion."
<br />
<br /> Councilman Hawks abstained from voting since the applicant
<br />is a client of his firm.
