That the use permit is approved subject to the following conditions which <br />the applicant and any successor in interest shall observe: <br /> <br />(a) The applicant shall submit to all required inspections by the City's Fire <br />Prevention Bureau, Public Health Department and Building Official. This shall include <br />an initial inspection prior to the opening of the business and annual inspections <br />thereafter. <br /> <br />(b) The hours of operation shall be from 10 a. m. to 6 p. m. <br /> <br />(c) The applicant shall provide two (2) off-street parking spaces. <br /> <br />(d) All exterior renovations to the fagade must be submitted to the <br />Downtown Design Committee for approval. <br /> <br />(e) The applicant shall comply with all the applicable codes, ordinances, and <br />regulations of federal, state and local governments and shall obtain and maintain all <br />necessary licenses and permits. <br /> <br />(f) All taxes and fees owed or collected in connection with the subject <br />property and operations shall be paid when due. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions <br />may serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />05 - 260 - Code amendment: <br /> <br />Motion by Mr. Whitehurst, and seconded by Ms. Psimas, to adopt the following <br />ordinance, approved on first reading at the June 14, 2005 meeting, and was adopted <br />by the following vote: <br /> <br />05 - 260(d) <br /> <br />"AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 40-22 AND 40-43.4 <br />AND TABLE 40-43.1.2 THEREOF PERTAINING TO ZONING REQUIREMENTS <br />FOR BODY ART ESTABLISHMENTS." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Whitehurst, Holley <br />Nays: Smith <br /> <br />- City Manager's Report - <br /> <br />05 - 284 - Adoption of an ordinance to appropriate $182,500 from the Bryne/COJ <br />Grant Program to the Portsmouth Adult Drug Treatment Court for continued operation <br />of the program. No City cash match required. Vision Principle: Neighborhood and <br />Community Transformation. <br /> <br />Background: <br />. The Portsmouth Adult Drug Treatment Court was established to serve as an <br />intensive treatment program for the purpose of treating nonviolent felony offenders <br />who are dependent upon drugs and/or alcohol. <br />. This program was implemented on January 16,2005 with federal funds. <br /> <br />Discussion: <br />. Financial Impact: There is no City cash match required. <br />
