June 28. 2005 If, within six (6) months of the date of such letter, the Director of Planning and Zoning determines that the offenses against peace and good order are continuing, then he may initiate proceedings for the revocation of this permit. Provided, however, that if such problems are of severity that the Chief of Police determines that there is a significant risk to public safety or peace and good order of such proportions as to create a risk of blight, the revocation proceedings may be initiated by the Director of Planning and Zoning regardless of the six (6) month requirement which is otherwise applicable. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." 05-260(c): "A RESOLUTION GRANTING A USE PERMIT TO CARLENE MCFARLAND FOR A CRAFTS AND GIFT SHOP AT 510 MIDDLE STREET. WHEREAS, Carlene McFarland has made application pursuant to Section 40- 43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate a crafts and gift shop at 510 Middle Street; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended granting the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That a use permit is hereby granted pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a crafts and gift shop at 510 Middle Street, and being more particularly described as: UP-05-13 Beginning at southwest intersection of High Street and Crawford Street, thence in a westerly direction 400 feet; thence in a southerly direction 100 feet to the point of beginning; thence in a westerly direction 85 feet to a point; thence in a southerly direction 40 feet to a point; thence in an easterly direction 85 feet thence in a northerly direction 40 feet to the point of beginning.
