<br />June 28. 2005 <br /> <br />If, within six (6) months of the date of such letter, the Director of Planning and Zoning <br />determines that the offenses against peace and good order are continuing, then he <br />may initiate proceedings for the revocation of this permit. Provided, however, that if <br />such problems are of severity that the Chief of Police determines that there is a <br />significant risk to public safety or peace and good order of such proportions as to <br />create a risk of blight, the revocation proceedings may be initiated by the Director of <br />Planning and Zoning regardless of the six (6) month requirement which is otherwise <br />applicable. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions <br />may serve as grounds for revocation of the use permit by the City Council." <br /> <br />05-260(c): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO CARLENE MCFARLAND FOR A <br />CRAFTS AND GIFT SHOP AT 510 MIDDLE STREET. <br /> <br />WHEREAS, Carlene McFarland has made application pursuant to Section 40- <br />43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use <br />permit to operate a crafts and gift shop at 510 Middle Street; and <br /> <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended granting the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br />(a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br />(c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br />(d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br />(e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That a use permit is hereby granted pursuant to Section 40-43.1 of the <br />Code of the City of Portsmouth, Virginia (1988) for the operation of a crafts and gift <br />shop at 510 Middle Street, and being more particularly described as: <br /> <br />UP-05-13 <br /> <br />Beginning at southwest intersection of High Street and <br />Crawford Street, thence in a westerly direction 400 feet; thence in a <br />southerly direction 100 feet to the point of beginning; thence in a <br />westerly direction 85 feet to a point; thence in a southerly direction <br />40 feet to a point; thence in an easterly direction 85 feet thence in a <br />northerly direction 40 feet to the point of beginning. <br />
