February 13, 2001 <br /> <br />That the use of the parcels will not interfere with Portsmouth's use of <br />Lake Kilby as a potable water reservoir and that the land so transferred <br />to the Commonwealth will be placed in a permanent conservation or <br />other similar environmental easement. <br /> <br />· That the use of the parcels will not restrict the free flow of Lake Kilby. <br /> <br />That the ownership of the parcels will not preclude Portsmouth's right <br />of ingress/egress beneath the new US Route 58 bridge to be <br />constructed by VDOT. <br /> <br />That the parcels conveyed by the City to the Commonwealth will revert <br />to the City in fee simple absolute if VDOT has no need for the parcels <br />by virtue of VDOT's abandonment of the parcels for road purposes. <br /> <br />· The 32.464 acre parcel received by Portsmouth from the Commonwealth is adjacent <br />to the Lake Kilby Water Plant's residuals lagoon and may be used for expansion of the <br />lagoon, as buffer area, or for future wetlands mitigation. <br /> <br />· This conveyance of the 32.464 acres of land to the City by VDOT will contain a <br />reverter clause providing that if the City should abandon its use, it will revert to the <br />Commonwealth in fee simple absolute. <br /> <br />Financial Impact: <br /> <br />· There is no direct financial impact, as the lands to be conveyed by the City to the <br />Commonwealth and the Commonwealth to the City, are being exchanged. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Pitts, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE DEEDS OF <br />CONVEYANCE, NECESSARY EASEMENTS FOR ACCESS, LIGHT OR AIR, A <br />PERMANENT EASEMENT FOR DRAINAGE FACILITIES AND TEMPORARY <br />CONSTRUCTION EASEMENTS TO THE COMMONWEALTH OF VIRGINIA FOR <br />PARCELS OF LAND IN THE CITY OF SUFFOLK NECESSARY TO THE <br />CONSTRUCTION OF THE SOUTHWEST SUFFOLK BYPASS AND THE WIDENING <br />OF MURPHY'S MILL ROAD (STATE ROUTE 638), AND TO ACCEPT A DEED FROM <br />THE COMMONWEALTH OF VIRGINIA TO THE CITY OF PORTSMOUTH FOR <br />LANDS IN THE CITY OF SUFFOLK BEING CONVEYED TO THE CITY OF <br />PORTSMOUTH IN EXCHANGE. <br /> <br /> BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the <br />City Manager be, and he hereby is, authorized to execute deeds of conveyance to the <br />Commonwealth of Virginia for lands located in the City of Suffolk, Virginia, which lands <br />are described as follows, to-wit: <br /> <br />Parcel 1: <br /> <br /> Parcels 001 and 024 - Being as shown on sheets 4 and 5 of the plans for Route <br />638, State Highway Project 0638-061-294, C501 and beginning on the south (right) side <br />of Route 638 construction centerline, from a point opposite approximate Station 143+92, <br />and ending on both sides of said centerline at approximate Station 150+85, the lands <br />now or formerly belonging to Mary B. Marlins, said area containing 0.484 acre, more or <br />less, land; <br /> <br /> Together with the prescriptive easement area, also together with the permanent <br />right and easement to use additional areas for the proper construction and maintenance <br />of drainage facilities opposite approximate Stations 148+00 (left), 148+70 (right) and <br />149+05 (left), said areas together containing 0.005 acre, more or less; together with the <br />temporary right and easement to use the additional areas shown as being required for <br />the proper construction of cut and/or fill together containing 0.190 acre, more or less. <br />Said temporary easements will terminate at such time as the construction of the <br />aforesaid project is completed. <br /> <br /> <br />
