Februaqf 13, 2001 <br /> <br /> Said deed shall provide for the following: Title to this property shall revert to the <br />City of Portsmouth, Virginia in fee simple absolute if VDOT's use of the property ever <br />becomes unnecessary by virtue of the uses of same being abandoned; that the property <br />so transferred shall be placed in a permanent conservation easement or other restrictive <br />easement designed to protect Portsmouth's potable water reservoirs; and that the <br />property will be managed and maintained to prevent sedimentation and pollution of <br />Portsmouth's potable water reservoirs. <br /> <br />Parcel 2: <br /> <br /> Parcel 047 - Being as shown on sheet 9B of the plans for the Southwest Suffolk <br />Bypass, State Highway Project R000-061-F01, RW201 and beginning on the north (left) <br />side of the control point line from a point opposite approximate Station 11 +55, to a point <br />opposite approximate Station 30+20 and containing 5.795 acres, more or less, land. <br /> <br /> Said deed shall provide for the following: Title to this shall revert to the City of <br />Portsmouth, Virginia in fee simple absolute if VDOT's use of the property ever becomes <br />unnecessary by virtue of the uses of same being abandoned; that the property so <br />transferred shall be placed in a permanent conservation easement or other restrictive <br />easement designed to protect Portsmouth's potable water reservoirs; and that the <br />property will be managed and maintained to prevent sedimentation and pollution of <br />Portsmouth potable water reservoirs. <br /> <br />Parcel 3: <br /> <br /> Parcel 017 - Being as shown on Sheets 7 and 8 of the plans for the Southwest <br />Suffolk Bypass, State Highway Project R000-061-F01, RW 201 and beginning on both <br />sides of the survey centerline from the lands now or formerly belonging to the <br />Department of Highways and Transportation of the Commonwealth of Virginia at <br />approximate station 1063+65 to the lands now or formerly belonging to Nations Bank <br />Trust at approximate Station 1076+37 and containing 6.311 acres, more or less, land. <br /> <br /> Said deed shall provide for the following: Title to this property shall revert to the <br />City of Portsmouth, Virginia in fee simple absolute if VDOT's use of the property ever <br />becomes unnecessary by virtue of the uses of same being abandoned; that the property <br />so transferred shall be placed in a permanent conservation easement or other restrictive <br />easement designed to protect Portsmouth's potable water reservoirs; and that the <br />property will be managed and maintained to prevent sedimentation and pollution of <br />Portsmouth's potable water reservoirs. The use of this property by VDOT will not in any <br />manner, interfere with Portsmouth's continued use of Lake Kilby as a potable water <br />reservoir, nor restrict the free flow of Lake Kilby, nor preclude Portsmouth's right of <br />ingress/egress beneath the bridge to be constructed across Lake Kilby. <br /> <br />Parcel 3A <br /> <br /> Any and all easements of access, light or air, incident to the lands of the Grantor <br />abutting upon the Limited Access Highway, and/or upon any of its ramps, loops, or <br />connections at and with intersecting highways, the line or lines along which easements <br />herein conveyed lie being described as follows: <br /> <br /> From a point on the proposed south right of way and limited access line opposite <br />approximate survey centerline Station 1063+50, the lands now or formerly belonging to <br />the Department of Highways and Transportation of the Commonwealth of Virginia; <br />thence along said proposed south right of way and limited access line to a point <br />opposite approximate Station 1076+50, the lands now or formerly belonging to Nation's <br />Bank Trust; also from a point on the proposed north right of way and limited access line <br />opposite approximate survey centerline Station 1064+05, the lands now or formerly <br />belonging to the Department of Highways and Transportation of the Commonwealth of <br />Virginia; thence along said proposed north right of way and limited access line to a point <br />opposite approximate Station 1076+12, the lands now or formerly belonging to Nations <br />Bank Trust. <br /> <br /> <br />
