<br />June 14. 2005 <br /> <br />Motion by Ms. Randall, and seconded by Mr. Whitehurst, to concur with the <br />recommendation of Planning Commission that UP-05-13 be approved on first reading, <br />and was adopted by a unanimous vote. <br /> <br />(d) CA-05-01 <br /> <br />CITYWIDE - The City of Portsmouth requests a code <br />amendment to Section 40-43.1-2, Section 40-43.4 and Section <br />40-22 of the Zoning Ordinance to allow for body art studios in the <br />M-1 and M-2 districts with a use permit. Vision Principle: Bold <br />New Directions. <br /> <br />1. Christopher Bowman, 22 Bowman Avenue, spoke in support of this item. <br /> <br />2. Dr. Antonio Iglesia, 2518 Charity Drive, Virginia Beach, spoke in support of this <br />item. <br /> <br />3. Glen Estes, 2198 Caratake Highway, Moyock, North Carolina, spoke in support of <br />this item. <br /> <br />4. Thomas W. Benvenuto, 3409 George Washington Highway, spoke in support of <br />this item. <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Heretick, to concur with the <br />recommendation of Planning Commission that CA-05-01 be approved on first reading, <br />and was adopted by a vote of 6-1 (Smith). <br /> <br />- Unfinished Business - <br /> <br />05 - 240 - Rezoning and use permits: <br /> <br />Motion by Mr. Whitehurst, and seconded by Ms. Psimas, to adopt the following <br />ordinance, approved on first reading at the May 24, 2005 meeting, and was adopted <br />by the following vote: <br /> <br />05-240(a): <br />"ZONING AMENDMENT ORDINANCE Z-05-07." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />Motion by Mr. Moody, and seconded by Mr. Whitehurst, to adopt the following <br />resolution, approved on first reading at the May 24, 2005 meeting, and was adopted <br />by the following vote: <br /> <br />05-240(b): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO NOBLE STREET BAPTIST <br />CHURCH TO OPERATE A CHILD CARE CENTER AT 100 AND 173 NOBLE <br />STREET. <br /> <br />WHEREAS, Noble Street Baptist Church, pursuant to Section 40-43.1 of <br />the Code of the City of Portsmouth, Virginia (1988) for the granting of a use <br />permit for the operation of a child care center at 100 and 173 Noble Street, <br />Portsmouth, Virginia; and <br /> <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1.
