June 14. 2005 Motion by Ms. Randall, and seconded by Mr. Whitehurst, to concur with the recommendation of Planning Commission that UP-05-13 be approved on first reading, and was adopted by a unanimous vote. (d) CA-05-01 CITYWIDE - The City of Portsmouth requests a code amendment to Section 40-43.1-2, Section 40-43.4 and Section 40-22 of the Zoning Ordinance to allow for body art studios in the M-1 and M-2 districts with a use permit. Motion by Mr. Whitehurst, and seconded by Mr. Heretick, to concur with the recommendation of Planning Commission that CA-05-01 be approved on first reading, and was adopted by a vote of 6-1 (Smith). - Unfinished Business - 05 - 240 - Rezoning and use permits: Motion by Mr. Whitehurst, and seconded by Ms. Psimas, to adopt the following ordinance, approved on first reading at the May 24, 2005 meeting, and was adopted by the following vote: 05-240(a): "ZONING AMENDMENT ORDINANCE Z-05-07." Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley Nays: None Motion by Mr. Moody, and seconded by Mr. Whitehurst, to adopt the following resolution, approved on first reading at the May 24, 2005 meeting, and was adopted by the following vote: 05-240(b): "A RESOLUTION GRANTING A USE PERMIT TO NOBLE STREET BAPTIST CHURCH TO OPERATE A CHILD CARE CENTER AT 100 AND 173 NOBLE STREET. WHEREAS, Noble Street Baptist Church, pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit for the operation of a child care center at 100 and 173 Noble Street, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of the application for a use permit with conditions.
