<br />June 14. 2005 <br /> <br />(a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br />(c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br />(d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br />(e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That Noble Street Baptist Church is hereby granted a use permit pursuant to <br />Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the <br />operation of a child care center at 100 and 107 Noble Street, and being more <br />particularly described as: <br /> <br />UP-05-09 <br /> <br />Beginning at the southeast intersection of Portsmouth <br />Boulevard and Noble Street, thence in a southerly direction <br />360 feet to a point; thence in an easterly direction 120 feet to <br />a point; thence in a northerly direction 360 feet to a point; <br />thence in a westerly direction 120 feet to the point of <br />beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicants and any successor in interest: <br /> <br />(a) The applicant shall care for no more than thirty children at any given <br /> <br />time. <br /> <br />(b) The ages of the children in full day daycare shall be limited to six months <br />to four years, and the ages of children in the before and after school care program <br />shall be limited to those between the ages of five and twelve. <br /> <br />(c) The hours of operation shall be limited to 6AM-6PM, Monday-Friday. <br /> <br />(d) Outside playtime shall be limited to 8AM-6PM. <br /> <br />(e) Children two and a half years of age and younger shall be cared for in a <br />room that has an exit directly to the exterior of the building. The issuance of the use <br />permit will be contingent on the applicant receiving a certificate of Occupancy from the <br />Building Official. <br /> <br />(f) The applicant shall provide a controlled walkway for the children to get <br />from the church building to the outdoor play area. The walkway proposal will be <br />approved during the site plan process. <br /> <br />(g) The applicant shall submit a new site plan that adheres to the conditions <br />of the use permit for approval by the Director of Engineering. <br /> <br />(h) The applicant shall use the proposed fenced in area on the south side of <br />the property as a play yard for the daycare. This area shall be at least 3,770 square <br />feet and be surrounded by a six-foot tall fence. <br /> <br />(i) Landscaping shall be planted on the southern and eastern ends of the <br />property adjacent to the play area to buffer the childcare facility from the adjacent <br />residential uses. <br />
