<br />recommendation of the Planning Commission that Z-05-04 be approved on first
<br />reading, and was adopted by unanimous vote.

<br />HIGHLANDS NEIGHBORHOOD - Ordinance granting the request
<br />of Portsmouth Venture One, LLC, to close a portion of Belmont
<br />Avenue, Dekalb Avenue, Barclay Avenue, Kirby Street,
<br />Appomattox Avenue, Bide-A-Wee Lane, Dorset Avenue, McLean
<br />Street, Independence Court, Nathan Court, Dekalb Court and
<br />Gygax Avenue. Vision Principle: Neighborhood and Community
<br />Transformation. The Comprehensive Plan recommends
<br />medium-density residential development.

<br />1. Anthony Giacoia. 902 Copper Stone Circle, Chesapeake, spoke in support of this
<br />item.

<br />Motion by Ms. Psi mas, and seconded by Mr. Whitehurst, to adopt the following

<br />God requests a use permit to reopen a church at 812 Washington
<br />Street. The property is zoned downtown D-1-P public. Deferred
<br />from the January 11, 2005 City Council meeting. Vision Principle:
<br />Neighborhood and Community Transformation.

<br />Motion by Mr. Whitehurst, and seconded by Ms. Randall, to defer consideration
<br />of UP-04-18 to the meeting of May 24,2005, and was adopted by unanimous vote.

<br />04 - 476 - Rezoning:
<br />
<br />(a) Ordinance granting the request of the Economic Development Authority to
<br />rezone property at 2900 Turnpike Road from Residential, RM-60 to Commercial,
<br />C-2-K (conditional) to allow commercial development on the Site. Deferred from
<br />the January 11, 2005 City Council meeting. Vision Principle: Neighborhood and
<br />Community Transformation. (Z-04-07) (First Reading Vote 7-0)

<br />Motion by Mr. Whitehurst, and seconded by Mr. Smith, to accept staff's
<br />withdrawn of item 04-476(a), approved on first reading at the December 14, 2004
<br />meeting, and was adopted by unanimous vote.

<br />- City Manager's Report -
<br />
<br />05 - 223 - Adoption of an ordinance to amend the Code of the City of Portsmouth,
<br />Virginia by revising Section 23-48 (c) and 23-50 (f) to insure that any vehicles towed
<br />for non-compliance of the City Code will not be permitted to go to any location within
<br />the City without coming into compliance first. Vision Principle: Neighborhood and
<br />Community Transformation.
