<br />At a Regular Meeting of the City Council on Tuesday, May 10, 2005,
<br />there were present:
<br />
<br />Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall,
<br />Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., Interim City Manager
<br />James B. Oliver, Jr., City Attorney G. Timothy Oksman.
<br />
<br />Reverend John M. Robertson, Pastor, River Shore Baptist Church, opened the
<br />meeting with prayer, which was followed by the Pledge of Allegiance to the Flag, led
<br />by Boy Scout Troop 219.
<br />
<br />Vice Mayor Moody called the meeting to order and welcomed all in attendance.
<br />
<br />Motion by Mr. Whitehurst, and seconded by Ms. Randall, to approve the
<br />minutes of a Special Called Meeting on April 19, 2005, a Called Meeting on
<br />April 26, 2005, a Regular Meeting on April 26, 2005, and a Special Called Meeting on
<br />May 3, 2005, and was adopted by unanimous vote.

<br />05 - 221 - Presentations:
<br />
<br />. Proclamation presented to Postmaster Patricia Snow for "NALC National Food
<br />Drive Day."
<br />
<br />. Proclamation presented to Margaret and John Nourie for "National Safe Boating
<br />Week."
<br />
<br />- Public Hearing -
<br />
<br />05 - 222 - Public hearing on group housing, use permit, rezoning and street closure
<br />applications:
<br />
<br />(a) GHP-05-02
<br />
<br />DOWNTOWN NEIGHBORHOOD - Robyn Thomas, agent for
<br />Joseph and Elane Caplan, request a group housing use permit for
<br />three (3) apartment units at 630 High Street. Vision Principle:
<br />Neighborhood and Community Transformation. The
<br />Comprehensive Plan recommends commercial development.
<br />
<br />Motion by Mr. Heretick, and seconded by Ms. Psimas, to concur with the
<br />recommendation of the Planning Commission that GHP-05-02 be approved on first
<br />reading, and was adopted by unanimous vote.
<br />
<br />(b) UP-05-11
<br />
<br />DOWNTOWN CORRIDOR - Olde Towne Day Spa, Inc. requests
<br />a use permit to operate a day spa at 516 Middle Street which is
<br />part of the Middle Street Mall. Vision Principle: Neighborhood
<br />and Community Transformation. The Comprehensive Plan
<br />recommends commercial development.
<br />
<br />Motion by Ms. Randall, and seconded by Mr. Whitehurst, to concur with the
<br />recommendation of the Planning Commission that UP-05-11 be approved on first
<br />reading, and was adopted by unanimous vote.

<br />(c) Z-05-04
<br />
<br />CHURCHLAND WEST NEIGHBORHOOD - Roger Pope,
<br />representing Land Design and Development, Inc., requests
<br />rezoning property near the intersection of Towne Point Road and
<br />Twin Pines Road from Commercial, C-1 to Residential
<br />multi-family, RM-75. Vision Principle: Neighborhood and
<br />Community Transformation. The Comprehensive Plan
<br />recommends medium-density residential development.
<br />
