The Clerk of the Circuit Court submitted personnel changes to the Compensation <br />Board with an effective date of March 1, 2005. Adoption of a resolution authorizing the City Manager to execute a deed to convey <br />the portion of Gwaltney Court closed and vacated by adoption of an ordinance by the <br />City Council on September 14, 2004. <br /> <br />Summary: <br /> <br />. This proposed deed will eliminate any question of the passage of title of the closed <br />portion of the street to Mr. Russell J. Oliveira, the adjoining landowner. <br /> <br />Purpose and Need: <br /> <br />. Ordinance 2004-47 was adopted to close and vacate a portion of Gwaltney Court <br />in order that this unneeded property go to Russell J. Oliveira, the adjoining landowner. <br /> <br />. In turn, Oliveira had agreed to convey an easement for drainage across his <br />adjoining property to serve the new subdivision of Gwaltney Acres. <br /> <br />. In compliance with the agreement between the City and Mr. Oliveira, Mr. Oliveira <br />has granted the City the required drainage easement. A deed is now needed to <br />confirm title to the closed and vacated area of the street to Mr. Oliveira, and/or his <br />successor in title, so as to complete the intent of the closed area of the street <br />becoming the property of Mr. Oliveira. <br /> <br />. The proposed deed will eliminate any question by title insurers of the passage of <br />the title of the closed portion of the street to Mr. Oliveira. <br /> <br />. The land acquired by Mr. Oliveira allows for new development along Smithfield <br />Road. <br /> <br />. This action will contribute toward the City Council's vision of Neighborhood and <br />Community Transformation and A Robust and Prospering Economy with the future <br />development of two new residences in Gwaltney Acres. <br />
