<br />March 8. 2005 <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Moody, to defer consideration <br />of CP-05-01 to the public hearing meeting of April 12, 2005, and was adopted by a <br />unanimous vote. <br /> <br />(b) Z-05-01 <br /> <br />RIVER POINTE NEIGHBORHOOD - River Pointe Associates, <br />LLC requests to modify the conditional zoning of Parcel B, also <br />known as the Villas, from residential, RM-75-K (conditional) to <br />residential, RM-75-K (conditional). The proposal would amend <br />the age limitations. Vision Principle: Neighborhood and <br />Community Transformation. <br /> <br />1. Vincent Napolitano, 1492 South Independence Boulevard, Virginia Beach, spoke <br />in support of this item. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Whitehurst, to concur with the <br />recommendation of the Planning Commission that Z-05-01 be approved on first <br />reading, and was adopted by a unanimous vote. <br /> <br />(c) Z-05-03 <br /> <br />HATTON POINT NEIGHBORHOOD -The YMCA of Portsmouth <br />requests a rezoning from single-family residential, RS-150 to <br />office residential (conditional), OR-75-K for the proposed <br />expansion of their facility and a modification of the proffers to <br />allow for a physical therapy center at their facility located at 4900 <br />High Street West. Vision Principal: Neighborhood and <br />Community Transformation. <br /> <br />1. Albert Taylor, 2902 Tanbark Lane, spoke in support of this item. <br /> <br />Motion by Mr. Moody, and seconded by Ms. Psimas, to concur with the <br />recommendation of the Planning Commission that Z-05-03 be approved on first <br />reading, and was adopted by a unanimous vote. <br /> <br />(d) UP-05-04 <br /> <br />HATTON POINT NEIGHBORHOOD - The YMCA of Portsmouth <br />requests a use permit to operate a childcare center in the <br />proposed expansion of their facility at 4900 High Street West. <br />Vision Principal: Neighborhood and Community Transformation. <br /> <br />Motion by Mr. Moody, and seconded by Ms. Psimas, to concur with the <br />recommendation of the Planning Commission that UP-05-04 be approved on first <br />reading, and was adopted by a unanimous vote. <br /> <br />(e) UP-04-24 <br /> <br />DOWNTOWN CORRIDOR - The Bier Garden is requesting a <br />use permit to expand their facility at 432 High Street. The <br />applicant is also requesting a parking exception to address an <br />increased number of staff and customer seating. Vision <br />Principle: A Robust and Prospering Economy. <br /> <br />1. Mark Geduldig-Yatrofsky, 363 Middle Street, spoke in support of this item. <br /> <br />2. Martha Ann Creecy, 317 Dinwiddie Street, spoke in opposition to this item. <br /> <br />3. Cecil Goodwin, 507 Oaklette Drive, Chesapeake, spoke in opposition to this item. <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Whitehurst, to concur with the <br />recommendation of the Planning Commission that UP-04-24 be approved on first <br />reading, and was adopted by a unanimous vote. <br /> <br />- City Manager's Report - <br /> <br />05 - 110 - Adoption of an ordinance to accept $35,547 from the Virginia Department of <br />Health, Office of Emergency Services, and to appropriate the same amount in the <br />Grants Fund for the training of emergency medical service personnel and for the <br />purchase of necessary equipment and supplies. <br />
