<br />February 22. 2005 <br /> <br />Motion by Mr. Moody, and seconded by Mr. Whitehurst, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE TO AMEND CHAPTER 23 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTION 23-46 THROUGH <br />23-48 AND 23-50 THEREOF PERTAINING TO INOPERABLE MOTOR VEHICLES." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />05 - 79 - Adoption of a resolution to exceed the 25% limit of allowable change orders <br />to the contracts for design and construction of the Frederick Boulevard Water Storage <br />and Pumping Facility. <br /> <br />This action will provide for the necessary change orders with McKim and Creed <br />for adjustment to design, engineering and construction administration tasks and <br />with T. A. Sheets Mechanical for additional work related to the site relocation <br />and construction of this project. Since 2002 when the contracts were awarded, <br />many changes have occurred including relocation of the site to across the <br />street and the unanticipated land acquisition costs etc. Vision Principles: <br />Robust and Prospering Economy, Pride of the Past and Promise of the Future. <br /> <br />Recommended Action: <br /> <br />. Adoption of a resolution to exceed the 25% limit of allowable change orders to the <br />contracts for design and construction of the Frederick Boulevard Water Storage and <br />Pumping Facility. <br /> <br />Summary: <br /> <br />. Since the original contracts were awarded for this project, many changes have <br />occurred primarily the relocation of the project site to across the street and the <br />unanticipated land acquisition costs, etc. This action will provide for the necessary <br />change orders with McKim and Creed for adjustment to design, engineering and <br />construction administration tasks and with T. A. Sheets Mechanical for additional work <br />related to the site relocation and construction of this project. <br /> <br />Purpose and Need: <br /> <br />. In 1999, the Department of Public Utilities selected McKim and Creed under its <br />Professional Service Agreement for design, engineering, and construction <br />administration of this project, and in February 2002, the City awarded a contract to T. <br />A. Sheets Mechanical for construction. <br /> <br />. A change in the location of the project to a location across the street required <br />significant changes to the design, and delayed construction. The relocation resulted <br />in a delay in the project's initiation, with an associate escalation in costs, the <br />requirement for a pile-supported foundation, and other changes. <br /> <br />. In accordance with Section 12-183 of the City Code, purchase orders are allowed <br />to <br />increase no more than 25% without approval of the City Council. This project is at that <br />threshold. <br /> <br />. The project contributes to the City Council's vision of a Robust and Prospering <br />Economy by achieving state-of-the-art water system that is a resource to serve the <br />needs of the City of Portsmouth and provides contractual water services to other <br />localities in the region. The Portsmouth Department of Public Utilities and the water <br />system is a resource that also reflects Pride of the Past and Promise of the Future, <br /> <br />Financial Impact: <br /> <br />. The circumstances around this project have resulted in a change order to the <br />original contract increasing the construction costs from $3. 817 to $4.840 million. <br />
