<br />February 22. 2005 <br /> <br />. Funding is available in the budget line for this change. <br /> <br />Motion by Mr. Whitehurst, and seconded by Ms. Psimas, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE EXPENDITURE OF FUNDS IN EXCESS OF <br />25% OF THE ORIGINAL CONTRACT AMOUNTS FOR THE DESIGN AND <br />CONSTRUCTION OF THE FREDERICK BOULEVARD WATER STORAGE AND <br />PUMPING FACILITY. <br /> <br />WHEREAS, in 2002, the City of Portsmouth entered into contracts for the design <br />and the construction of the Frederick Boulevard Water Storage and Pumping Facility; <br />and <br /> <br />WHEREAS, since the contracts were awarded, unanticipated events such as the <br />relocation of the project from the City Compound, ensuing acquisition costs and <br />additional construction costs resulting from the new site have caused the actual cost of <br />the construction project to exceed the contract amounts of $470,473 for the design and <br />$3,817,000 for the construction by more than 25%; and <br /> <br />WHEREAS, City Code section 12-183 requires that City Council authorize any <br />increase to a contract in excess of 25% of the original contract amount. <br /> <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that it hereby authorizes the expenditure of funds in excess of 25% of the <br />original contract amounts for the design and construction of the Frederick Boulevard <br />Water Storage and Pumping Facility. <br /> <br />BE IT FURTHER RESOLVED that a copy of this Resolution be included in the <br />Contract Documents for this project. <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />- New Business - <br /> <br />05 - 80 - Boards and Commissions <br /> <br />There were no appointments. <br /> <br />05 - 81 - Items Submitted by Council Members <br /> <br />There were no items submitted. <br /> <br />05 - 82 - Report on Pending Items <br /> <br />There were no pending items. <br /> <br />05 - 83 - Non-Agenda Speakers <br /> <br />1. Deputy Charles Kerry, 701 Crawford Street, introduced the Project Lifesaver <br />program to the citizens of Portsmouth. <br /> <br />2. Cheryl K. Jenkins, 1625 Belafonte Drive, spoke on March of Dimes Walk-America <br />events on May 14, 2005. <br /> <br />3. Edward (Ned) McCabe, 602 Rockbridge Road, spoke on three History Commission <br />Projects: the 1812 Overture Project, June 14, 2005, Flag Day, and a ceremony <br />commemorating the Battle of Craney Island. Also, he mentioned a State award for <br />the Portsmouth Reads Program. <br /> <br />4. Dan Wendell, 113 Afton Parkway, spoke on personal property concerns in <br />Cradock. <br />
