<br />CITY MANAGER'S REPORT
<br />
<br />94-50 - Letter from the City Manager regarding adoption of a
<br />resolution on the application of the Portsmouth Veterans Home,
<br />Inc. for designation as a charitable and benevolent organization
<br />within the context of Section 6 (a) (6) of Article X of the
<br />Constitution of Virginia.
<br />
<br /> "The Portsmouth Veterans Home, Inc., a charitable
<br />organization, has applied for exemption from taxation within the
<br />context of Section 6(a} of Article X of the Constitution of
<br />Virginia. The City Assessor has reviewed the application, and
<br />it is his opinion that the appropriate responses were completed
<br />and on that basis, the exemption could be granted.
<br />
<br /> Property used exclusively by non-profit organizations for
<br />religious, charitable, patriotic, historic, benevolent, cultural
<br />or public park and playground purposes, however, is not entitled
<br />to an automatic tax exemption if acquired subsequent to July 1,
<br />1971. As you well know, almost 60% of the real estate land
<br />value in our City is already non-taxable. I have been, and
<br />still remain, seriously concerned about the impact of any
<br />additional non-taxable property and believe we absolutely must
<br />reverse this trend. The applicant's real property is assessed
<br />at $224,080.00 which would produce tax revenue in the amount of
<br />$2,957.84 for the current tax year.
<br />
<br /> While I have no objection, whatsoever, toward this
<br />non-profit organization which provides a meeting hall and
<br />assists area veterans in filing for compensation and in other
<br />matters pertaining to veterans' benefits, I must recommend
<br />denial of this request for property tax exemption."

<br /> Motion by Mr. Clemons, and seconded by Mr. King, to adopt
<br />the following resolution, and was adopted by the following vote:
<br />
<br /> "A RESOLUTION SUPPORTING THE APPLICATION OF PORTSMOUTH
<br />VETERANS HOME, INC., FOR DESIGNATION AS A CHARITABLE AND
<br />BENEVOLENT ORGANIZATION WITHIN THE CONTEXT OF SECTION 6 (a)
<br />OF ARTICLE X OF THE CONSTITUTION OF VIRGINIA.

<br /> WHEREAS, in accordance with Section 30-19.04 of the Code
<br />of Virginia, 1950, as amended, the Council of the City of
<br />Portsmouth, Virginia, held a Public Hearing on Tuesday, February
<br />8, 1994, to consider the application for exemption from taxes
<br />filed on behalf of Portsmouth Veterans Home, Inc., Portsmouth
<br />Federal Chapter 922, for property located at 4648 Portsmouth
<br />Boulevard, Portsmouth, Virginia, and used by the applicant
<br />exclusively for charitable and benevolent purposes on a
<br />non-profit basis as set forth in Section 58.1-3650 of the Code
<br />of Virginia, 1950, as amended; and
<br />
<br /> WHEREAS, the Council of the City of Portsmouth, Virginia,
<br />has examined and considered the provisions of Section
<br />30-19.04(B) of the Code of Virginia, 1950, as amended, with
<br />respect to the petition of Portsmouth Veterans Home, Inc., and
<br />determined that the assessed value of the property owned by
<br />Portsmouth Veterans Home, Inc., in Portsmouth, Virginia, is
<br />224,080.00 which would produce tax revenue in the amount of
<br />2,957.84 for the current tax year.
