Louise Lucas and Frederick M. Quayle and
Delegates William S. Moore, Jr., and Kenneth R. Melvin."

Ayes: Clemons, Hawks, King, Pitts
Nays: Epperson, Griffin, Webb

CITY MANAGER'S REPORT

94-50 - Letter from the City Manager regarding adoption of a
resolution on the application of the Portsmouth Veterans Home,
Inc. for designation as a charitable and benevolent organization
within the context of Section 6 (a) (6) of Article X of the
Constitution of Virginia.

"The Portsmouth Veterans Home, Inc., a charitable
organization, has applied for exemption from taxation within the
context of Section 6(a} of Article X of the Constitution of
Virginia. The City Assessor has reviewed the application, and
it is his opinion that the appropriate responses were completed
and on that basis, the exemption could be granted.

Property used exclusively by non-profit organizations for
religious, charitable, patriotic, historic, benevolent, cultural
or public park and playground purposes, however, is not entitled
to an automatic tax exemption if acquired subsequent to July 1,
1971. As you well know, almost 60% of the real estate land
value in our City is already non-taxable. I have been, and
still remain, seriously concerned about the impact of any
additional non-taxable property and believe we absolutely must
reverse this trend. The applicant's real property is assessed
at $224,080.00 which would produce tax revenue in the amount of
$2,957.84 for the current tax year.

While I have no objection, whatsoever, toward this
non-profit organization which provides a meeting hall and
assists area veterans in filing for compensation and in other
matters pertaining to veterans' benefits, I must recommend
denial of this request for property tax exemption."

Motion by Mr. Clemons, and seconded by Mr. King, to adopt
the following resolution, and was adopted by the following vote:

"A RESOLUTION SUPPORTING THE APPLICATION OF PORTSMOUTH
VETERANS HOME, INC., FOR DESIGNATION AS A CHARITABLE AND
BENEVOLENT ORGANIZATION WITHIN THE CONTEXT OF SECTION 6 (a)
OF ARTICLE X OF THE CONSTITUTION OF VIRGINIA.

(6)

WHEREAS, in accordance with Section 30-19.04 of the Code
of Virginia, 1950, as amended, the Council of the City of
Portsmouth, Virginia, held a Public Hearing on Tuesday, February
8, 1994, to consider the application for exemption from taxes
filed on behalf of Portsmouth Veterans Home, Inc., Portsmouth
Federal Chapter 922, for property located at 4648 Portsmouth
Boulevard, Portsmouth, Virginia, and used by the applicant
exclusively for charitable and benevolent purposes on a
non-profit basis as set forth in Section 58.1-3650 of the Code
of Virginia, 1950, as amended; and

WHEREAS, the Council of the City of Portsmouth, Virginia,
has examined and considered the provisions of Section
30-19.04(B) of the Code of Virginia, 1950, as amended, with
respect to the petition of Portsmouth Veterans Home, Inc., and
determined that the assessed value of the property owned by
Portsmouth Veterans Home, Inc., in Portsmouth, Virginia, is
224,080.00 which would produce tax revenue in the amount of
2,957.84 for the current tax year.
