November 23, 2004 <br /> <br />Recommended Action: <br /> <br />· Adoption of an ordinance to refund the over assessment of Business Personal <br />Property Taxes paid for the Calendar year 2003-2004 for a total amount of $137,072.47 <br />to BASF, The Chemical Company. <br /> <br />Summary: <br /> <br />· The BASF Company acquired assets of the Clariant Corporation in 1998. <br />Subsequently, the assets of the company were deemed to be less that the amount paid <br />at closing and adjustments were made. These adjustments affected the basis of the <br />business personal property value used to taxing purposes. <br /> <br />Purpose and Need: <br /> <br />· In a letter dated July 19, 2004 addressed to Mr. A. James Fillion, Commissioner of <br />the Revenue, City of Portsmouth, Virginia, BASF, The Chemical Company, outlines its <br />request for an adjustment in its business personal property taxes. <br /> <br />· The Commissioner of the Revenue has negotiated with BASF to determine the <br />amount of over assessment and payment due (see below). <br /> <br />Financial Impact: <br /> <br />· Business Personal Property Tax refund is identified as follows: <br /> <br />Erroneous Taxes Paid: $137,072.47 <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Moody, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE AUTHORIZING A TAX REFUND TO BASF, THE CHEMICAL <br />COMPANY, RESULTING FROM THE OVER ASSESSMENT OF BUSINESS <br />PERSONAL PROPERTY TAX." <br /> <br />Ayes: Heretick, Moody, Psimas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />04 - 456 - Adoption of an ordinance to amend Chapter 9 of the Code of the City of <br />Portsmouth pertaining to the fees charged for work performed (opening and closing of <br />graves) and perpetual care in City-owned cemeteries. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Ms. Psimas, to withdraw 04-456 at <br />the request of the City Manager, and was adopted by unanimous vote. <br /> <br />04 - 457 - Adoption of a resolution authorizing the City of Portsmouth's 2005 Legislative <br />Proposals be presented to the Portsmouth Delegation and to the Virginia General <br />Assembly. <br /> <br />The 2005 Legislative Proposals were presented to City Council at the <br />November 15, 2004 City Council Public Work Session and subsequently to each <br />of the City's General Assembly delegation members. <br /> <br />Recommended Action: <br /> <br />· Adoption of a resolution authorizing the presentation of the City of Portsmouth's <br />2005 Legislative Proposals to the Portsmouth Delegation of the Virginia General <br />Assembly. <br /> <br />Summary: <br /> <br />· The 2005 Legislative Proposals were presented to City Council at the November 15, <br />2004 City Council Public Work Session, and subsequently to each of the City's General <br />Assembly Delegation Members. <br /> <br /> <br />
