October 26, 2004 <br /> <br />"ORDINANCE ACCEPTING $44,591 IN COMMONWEALTH OF VIRGINIA <br />TECHNOLOGY TRUST FUNDS AND APPROPRIATING SAID SUM IN THE <br />GENERAL FUND FOR TECHNOLOGY IMPROVEMENTS IN THE OFFICE OF THE <br />CIRCUIT COURT CLERK." <br /> <br />Ayes: Heretick, Moody, Randall, Smith, Whitehurst <br />Nays: None <br /> <br />04 - 416 - Adoption of a resolution to permit the change orders on the Lee Avenue- <br />Virginia Avenue Improvement Project with Branscome, Inc. to exceed the allowable <br />25% limit. <br /> <br />This construction project is providing roadway improvements in conjunction with <br />the Pinner's Point Interchange Project. Utility conflicts have caused the project <br />costs to exceed the allowable 25% limit above the original contract amount, <br />which required the approval of City Council. This project is funded 100% by the <br />Virginia Department of Transportation (VDOT) and the increase has been <br />approved by VDOT. <br /> <br />Recommended Action: <br /> <br />· Adoption of a resolution to permit the change orders on Lee Avenue-Virginia Avenue <br />Improvement Project with Branscome, Inc. to exceed the allowable 25% limit. <br /> <br />Summary: <br /> <br />· The Lee Avenue-Virginia Avenue construction project is providing roadway <br />improvements that are in conjunction with the Pinner's Point interchange project. <br />Underground utility conflicts have caused the project cost to exceed the allowable 25% <br />limit above the original contract amount. City Council approval is required to exceed the <br />25% limit. <br /> <br />Purpose and Need: <br /> <br />· The original contract value of improvements being made through the Lee Avenue- <br />Virginia Avenue Project is $689,876. <br /> <br />· Conflicts with underground utilities have necessitated change orders to the original <br />contract in excess of the allowable 25%. <br /> <br />· The City's procurement law allows a contract to exceed its original amount by no <br />more than 25% unless approved by City Council. <br /> <br />Financial Impact: <br /> <br />· The Lee Avenue-Virginia Avenue Project is funded 100% by the Virginia Department <br />of Transportation (VDOT) but is administered by the City of Portsmouth. No City match <br />is required. <br /> <br />· VDOT has already approved the increase in the project costs. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Ms. Randall, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE EXPENDITURE OF FUNDS IN EXCESS OF <br />25% OF $689,879.01 FOR IMPROVEMENTS TO LEE AND VIRGINIA AVENUES. <br /> <br /> WHEREAS, the City of Portsmouth entered into and has been administering a <br />contract for improvements to Lee and Virginia Avenues; and <br /> <br /> WHEREAS, unanticipated utility conflicts will cause the construction project to <br />exceed the contract amount of $689,876.01 by more than 25%; and <br /> <br /> <br />
