October 12, 2004 <br /> <br />· The lease provides for this temporary location of the Railroad Museum of Virginia, <br />Inc., a 501(c)(3) charitable organization. This agreement will facilitate fundraising <br />efforts toward the Museum that will speed the restoration of the railroad cars located on <br />the site. <br /> <br />Financial Impact: <br /> <br />· The property would be leased to the Railroad Museum of Virginia, Inc. for $1.00 per <br />year. <br /> <br />· With the configuration of the parcel, it is unlikely that it could be used for any other <br />purpose. <br /> <br />1. Mark Geduldig-Yatrofsky, 363 Middle Street, spoke on this item. <br /> <br />2. Willard J. Moody, Sr., 500 Crawford Street, spoke in support of this item. <br /> <br /> Motion by Ms. Psimas, and seconded by Mr. Heretick, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A LEASE <br />WITH THE RAILROAD MUSEUM OF VIRGINIA, INC. FOR A PORTION OF THE <br />FORMER CSX RAILROAD RIGHT OF WAY LYING EAST OF PORTCENTRE <br />PARKWAY. <br /> <br /> BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the <br />City Manager be, and he hereby is, authorized to execute an agreement with the <br />Railroad Museum of Virginia, Inc. to lease to the museum under such terms and <br />conditions as he shall deem appropriate and in the best interest of the City of <br />Portsmouth for the following described property, to-wit: <br /> <br />All that certain piece or parcel of land, situate in the City of Portsmouth, <br />Virginia, being a portion of the former railroad right of way granted to the <br />City of Portsmouth by CSX Transportation, Inc. by deed date September <br />13, 2000 and duly recorded in the Clerk's Office of the Circuit Court of the <br />City of Portsmouth, Virginia in Deed Book 1311, at page 122, being 37.50 <br />feet in width and 467.00 feet more or less, and running from the east right <br />of way line of Portcentre Parkway eastwardly 467.00', more or less, as <br />measured along the centerline of the track located thereon to the terminus <br />of the track. <br /> <br /> BE IT FURTHER RESOLVED that the Manager is authorized to execute such <br />plats or other documents that may be required to carry out the intent of this Resolution." <br /> <br />Ayes: Heretick, Moody, Psimas, Randall, Smith <br />Nays: None <br /> <br />- City Manager's Report - <br /> <br />04 - 395 - Adoption of an ordinance to amend the FY 2004-2005 Operating Budget for <br />the purpose of security enhancements and renovations to the facilities in the Office of <br />the Commissioner of the Revenue and to appropriate $50,000 of additional estimated <br />revenue from the Commonwealth for this purpose. <br /> <br />The Commissioner of the Revenue has requested various improvements to the <br />office design for day-to-day security for staff and citizens. <br /> <br />Recommended Action: <br /> <br />Adoption of an ordinance to amend the FY 2004-2005 Operating Budget for purpose <br />of security enhancements and renovations to the facilities of the Office of the <br />Commissioner of the Revenue and to appropriate $50,000 of additional estimated <br />revenue from the Commonwealth for this purpose. <br /> <br /> <br />
