October 12, 2004 <br /> <br /> (g) The applicant shall comply with the waste management plan approved by <br />the Department of General Services on August 13, 2004. <br /> <br /> (h) The applicant shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local governments and shall obtain and maintain all <br />necessary licenses and permits. <br /> <br /> (i) <br />due. <br /> <br />All taxes and fees owed in connection with the property shall be paid when <br /> <br /> 3. EXPIRATION OF PERMIT: Unless extended as provided under Section <br />40-115 of the Code of the City of Portsmouth, Virginia (1988), the group housing use <br />permit shall expire for any portion of the approved project for which building permits <br />have not been issued if the applicant fails to apply for all building permits for the entire <br />project within one year of the adoption of this resolution. <br /> <br /> 4. The Railroad Museum of Virginia, Inc. wishes to <br />lease the property where four railroad cars, presently owned by the Museum, are <br />stored on a portion of railroad track still located there. The lease provides that <br />the Museum would pay the City $1.00 each year for a five-year term for the <br />property and for a landlord/tenant relationship only. <br /> <br />Recommended Action: <br /> <br />· Adoption of a resolution authorizing the City Manager to execute a lease with the <br />Railroad Museum of Virginia, Inc. for the former CSX Railroad right-of-way property <br />between PortCentre Parkway and the terminus of the tracks near the Ntelos Pavilion. <br /> <br />Summary: <br />· This lease is intended to provide the Railroad Museum of Virginia, Inc. with a site <br />where it may store its railroad cars for a period of no more than five (5) years until future <br />plans for a railroad museum are finalized. The property will be leased to the Railroad <br />Museum for $1.00 per year. <br /> <br />Purpose and Need: <br /> <br />· This lease is intended to provide the Railroad Museum with a site where it may store <br />railroad cars that have been donated to the Museum while an agreement providing for <br />the operation of a railroad museum on this site and adjacent property owned by the <br />Virginia Department of Transportation is considered. <br /> <br /> <br />
