September 28, 2004 <br /> <br />04 - 371 - Adoption of a resolution authorizing the City Manager to execute a deed of <br />conveyance to the Commonwealth of Virginia's Department of Transportation (VDOT) <br />for a parcel of property to be used for a project railroad right-of-way to the Craney Island <br />Depot. <br /> <br />Upon the City's conveyance to VDOT and then VDOT's conveyance of the <br />railroad right-of-way to the Navy, the Navy will convey to the City permanent <br />rights of ingress/egress into the Churchland High School site and the bus parking <br />lot located at the southern end of the property. <br /> <br />Recommended Action: <br /> <br />· Adoption of a resolution authorizing the City Manager to execute a deed of <br />conveyance to the Commonwealth of Virginia the Department of Transportation (VDOT) <br />for a parcel of property at the Churchland High School site to be used for a projected <br />railroad right-of-way to the Craney Island Depot. <br /> <br />Summary: <br /> <br />· Upon the City's conveyance to VDOT and VDOT's conveyance of the railroad <br />right-of-way to the Navy, the Navy will convey to the City permanent rights of <br />ingress/egress into the Churchland High School site and the bus parking lot located at <br />the southern end of the property. <br /> <br />Purpose and Need: <br /> <br />· Upon construction of the Western Freeway, the Navy relinquished its railroad <br />right-of-way to Craney Island in order to provide for the widening of Cedar Lane. VDOT <br />agreed to convey land to the Navy for a new railroad right-of-way near Cedar Lane. <br /> <br />· One parcel of property needed for the right-of-way was omitted from VDOT <br />acquisition and that is the parcel identified for conveyance. <br /> <br />· This parcel of property is necessary for VDOT to replace the former Craney Island <br />railroad right-of-way as required by the United States Navy. <br /> <br />Financial Impact: <br /> <br />· There will be no financial impact. <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Whitehurst, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED OF <br />CONVEYANCE OF PROPERTY AT THE CHURCHLAND HIGH SCHOOL SITE TO <br />THE COMMONWEALTH OF VIRGINIA THE DEPARTMENT OF TRANSPORTATION <br />A RAILROAD RIGHT OF WAY TO THE CRANEY ISLAND DEPOT. <br /> <br /> BE IT RESOLVED, by the Council of the City of Portsmouth, Virginia, that the <br />City Manager be, and he hereby is, authorized to execute such deeds or other <br />documents as may be necessary to convey property at the Churchland High School site <br />to the Commonwealth of Virginia the Department of Transportation for a railroad right of <br />way to the Craney Island Depot, said property being described as follows: <br /> <br />5,599.00 s.f. or 0.1285 acres, more or less, as shown on "PLAT <br />SHOWING PROPERTY TO BE CONVEYED TO OMMONWEALTH <br />OF VIRGINIA FOR DEPARTMENT OF TRANSPORTATION, <br />PORTSMOUTH, VIRGINIA," dated December 13, 1991, prepared <br />by Horton & Dodd, P.C., Surveyors, Engineers & Planners, which <br />copy of said plat is attached hereto." <br /> <br />Ayes: Heretick, Moody, Psimas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br /> <br />
