Au.qust 10, 2004 0-( 3 <br /> <br /> (c) The project as a whole conforms to applicable requirements for minimum <br />required floor area for dwelling units, minimum allowable area for dwelling units, <br />maximum allowable area for the number of dwelling units, and the maximum allowable <br />area devoted to residential purposes; <br /> <br /> (d) The quantity, quality, utility, size and type of the project's open space and <br />landscaping improvements is sufficient to offset the decreases in dimensional <br />requirements or other deviations from the zoning district in which the project is located; <br /> <br /> (e) The project's internal traffic circulation system is adequate to provide for <br />the convenient and safe movement of vehicles and pedestrians, and the project will not <br />cause surrounding streets and roads to exceed their safe capacities; <br /> <br /> (f) The quantity, quality, utility and type of the project's community and <br />common facilities are sufficient to offset the decreases in dimensional requirements and <br />other deviations from the zoning district in which the project is located; <br /> <br /> (g) The project complies with the standards for approval of a use permit set <br />forth in Section 40-106 of the Code of the City of Portsmouth, Virginia; and <br /> <br /> (h) The project provides parking, building access and pathways for persons <br />with disabilities in accordance with the requirements of the Americans with Disabilities <br />Act. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia that: <br /> <br /> 1. A group housing use permit for the construction of thirteen residential townhouse <br />units is hereby granted subject to the following terms and conditions which shall apply to <br />the applicant and any successor in interest: <br /> <br />(a) The group housing project shall be limited to thirteen townhouse units. <br /> <br /> (b) The applicant shall construct the thirteen townhouse units in accordance <br />with the submitted floor plans and shall the building exteriors shall consist of a <br />combination of vinyl siding and brick as shown on the submitted exterior elevations on <br />file in the Office of Planning and Zoning. The Director of Planning and Zoning may <br />approve minor modifications to the plan. <br /> <br /> (c) A landscaping plan, developed by the applicant, must be submitted for <br />review and approval to the Director of Planning and Zoning. A landscaped buffer <br />meeting the requirements of Landscaping Group 2 shall be established and maintained <br />along the western and southern property lines. The Director of Planning and Zoning <br />must also approve any modification to the approved landscaping plan. <br /> <br /> (d) Street lighting with high pressure sodium fixtures shall be provided along <br />the proposed street (Empire Court) in accordance with Illumination Engineer Standards <br />for Roadways. A lighting plan for the development must be approved by the <br />Department of Public Works prior to issuance of any building permits. <br /> <br /> (e) The applicant shall be responsible for the cost and upgrading of utilities for <br />this development and shall coordinate with Director of Public Utilities on design of the <br />sewer line. <br /> <br /> (f) Any revisions to the site plan or landscaping plan or elevations made <br />through the group housing application process, including any changes by City Council, <br />must be submitted to the Director of Planning and Zoning for approval prior to issuance <br />of building permit. <br /> <br /> (g) The driveway to each unit shall be paved to a maximum width of ten feet. <br />The applicant shall ensure that the remaining area shall be landscaped. Parking <br />restrictions in this area shall be controlled through deed restriction. <br /> <br />(h) The applicant shall provide a recreational play area as identified on the <br />site plan. <br /> <br /> <br />
