072 <br /> <br />August 10, 2004 <br /> <br />"ORDINANCE CLOSING AND VACATING A PORTION OF ANN STREET, BLAIR <br />STREET, ARMSTRONG STREET, HOLLADAY STREET, BUTLER STREET AND <br />OWENS STREET." <br /> <br />Ayes: Heretick, Moody, Psimas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />- Unfinished Business - <br /> <br />04 - 288 - Group housing use permit: <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Smith, to adopt the following <br />resolution, approved on first reading at the July 13, 2004 meeting, and was adopted by <br />the following vote: <br /> <br />04-288(a): <br /> <br />"A RESOLUTION GRANTING A GROUP HOUSING USE PERMIT (GHP-04-04) T(: <br />AFFORDABLE RESIDENTIAL HOUSING, L.L.C. TO CONSTRUCT THIRTEEF <br />RESIDENTIAL TOWNHOUSE UNITS AT 3711 AND 37'15 TURNPIKE ROAD. <br /> <br /> WHEREAS, Lloyd Vaughan, Managing Partner of Affordable Residential <br />Housing, L.L.C., pursuant to Section 40-112 of the Code of the City of Portsmouth, <br />Virginia (1988), as amended, has applied for a group housing use permit for thirteen <br />residential townhouse units to be constructed at 3711 and 3715 Turnpike Road, <br />Portsmouth, Virginia; and <br /> <br />WHEREAS, the subject property is more particularly described as follows: <br /> <br />GHP-04-04 <br /> <br /> Beginning approximately 188 feet west of the intersection of <br />Rodman Avenue and Turnpike Road along the southern <br />right-of-way line of Turnpike Road; thence south approximately <br />427.23 feet to a point; thence west approximately 152.50 feet to a <br />point; thence north approximately 414.58 feet to a point; thence <br />east approximately 152.00 feet along the southern right-of-way line <br />of Turnpike Road to the point of beginning. <br /> <br />and <br /> <br /> WHEREAS, the Planning Commission has reviewed such application and site <br />plan submitted therewith and has recommended conditional approval of said <br />application; and <br /> <br /> WHEREAS, the applicant has been informed that approval of the group housing <br />project pursuant to Section 40-116 only grants an exemption from certain requirements <br />for residences as stated in said section and does not constitute a waiver of any other <br />requirement embodied in the Subdivision Ordinance, Zoning Ordinance, Code of the <br />City of Portsmouth, Virginia, or any other applicable local, state or federal law or <br />regulation; and <br /> <br /> WHEREAS, the applicant is aware that building permits and any other required <br />permit will be issued only upon compliance with the ordinances, laws or regulations <br />applicable thereto; and <br /> <br />WHEREAS, the following conditions exist: <br /> <br />(a) The proposed project is compatible with surrounding land uses; <br /> <br /> (b) The density of the project does not exceed the maximum allowable <br />density for the zoning district, and, where applicable, the floor-area ratio of the project <br />does not exceed the maximum allowable floor-area ratio for the zoning district; <br /> <br /> <br />
